  16. This trial is for additional damages, for his sexual assault guilt has already been proven in a previous trial. Carroll’s lawyer indicated they were seeking a judgement substantial enough for the supposed billionaire Trump to stop defaming her, as he has continued to do, so any judgement might run into the many millions of dollars.

    Today’s events in court were much the same, based on reporting. Habba has little working room here, but I can’t see how her unforced procedural fumbles and errors would help Trump’s already weak case. If Trump gets on the stand Monday and spins out of control it may cost him dearly..

  18. If you read The Daily Beast take on this, the judge was painted as being so, so unfair to Habba, but they don’t go into the meat of it (few quotes, and it is written like a game of telephone).

    Reading this article (with actual quotes) makes things so much clearer. She’s just not very good. When the judge has to remind the lawyer how to properly bring evidence into a case, or how to properly lawyer, those red flags should be waving.

  22. The problem is Trump supporters don’t see this as Habba getting shut down. They see it as the Judge being bully and prejudice against Trump.

    There’s needs to be real, tangible, painful sanctions.

    * Wednesday was the first day of testimony in Donald Trump’s second E. Jean Carroll defamation trial.
    * A fed-up Judge Lewis Kaplan rebuked the Trump lawyer Alina Habba at least 14 times during the day.
    * “Sit down,” he told her at one point. When she asked for a sidebar, he tersely responded, “No.”

  28. I read somewhere Trump’s PACs have paid her over 2 million over the last year. That’s some expensive ~~girlfriend experience~~ lawyering

  30. Reading through the various things Trump’s lawyer did in open court I’d have fired her on the spot. Not only does she not know basic procedure, like how to get a depo into evidence, but she ignores rulings on objections, and tries testifying while asking questions of a witness. Nothing like getting a judge on your side to aggressively argue with him repeatedly as you make basic mistakes a law student should probably know.

  31. They’ve baiting this judge to get angry in court. trump will appeal on the basis that the judge was prejudicial. Is that their plan?

  32. I don’t know why I was expecting for Habba’s errors to be a bit more sophisticated. I was a defense lawyer on my high school mock trial 25 years ago, didn’t go into law, and even I remembered most of these mistakes. 🤦‍♀️

  35. As a lawyer, this was painful to read. These all sound like rookie mistakes. I’ve never tried a case in my life, but I’m pretty sure that I wouldn’t be making most of these mistakes based solely on what I learned in law school.

    And, while it is possible to get through law school while never taking any classes on Trial Advocacy or Evidence, or other courtroom-related subjects, most law students take at least some of those courses anyway.

  39. That’s just painful. Anyone who’s watched a few episodes of Law & Order could do better than she can. I suspect this is all today groundwork for an appeal based on ineffectual counsel.
