  2. WRC is mostly about process being applied which it wasn’t here. However it’s beyond a joke that people just don’t show up to work despite not having holiday leave formally approved and then are surprised they lost their job as the customers they were supposed to server weren’t being served.

  3. Haha, generally when there is no process shown, it is fair enough but this is a glaring example of gross misconduct. Kind of an insane decision.

  4. Gotta follow policy and procedure or you’re goosed. As a manager I live by the rule of ‘have some respect for your colleagues or fuck off’ most people don’t fuck off, which means I have to create a team with that person on the fringes of productivity. But, that’s their choice and I’m not gonna force you to be decent, enjoy whatever it is you think you’re here for.

  5. Seems more like a situation of a workplace having a very loose holiday policy. If he gave 3 months notice and was then fired instead of reprimanded it more sounds like they should be logging annual leave better.

    In summary, another rage bait headline where both parties had some fault.

  6. Company fucked themselves. Yes the guy absolutely deserved sacking and the judge reflected that in the reduced award. However, you don’t get to totally throw disciplinary procedures out the window.

    Follow the process, the end would have been the same but with no WRC.

  8. Payout mostly seems to hinge on not having any proper dismissal process. Yes its bad to fuck off an holiday without having the time off approved, but you can’t fire people that casually either.

  9. As usual in most HR cases, the employer tripped up on procedure.

  11. I dunno, 3 months notice, that’s plenty of time to organise a temp to cover or redistribute the workload, they could have been accommodated with a well, ok, but we’ll have to organise cover, so you’ll need to take unpaid leave.

    Like 3 months notice, that’s insane. That’s if it’s on the level, and to swear that in court, dodgy if it’s not on the button.
