“Oathbreakers” sounds an appropriate title for Trump’s personal army.
It isn’t the fact that he told the mob to move to the Capital, it was he did absolutely nothing once the mob moved into the Capital.
Donny could have went to the Briefing Room immediately and told the mob to behave. He could have called General Miley to get troops in place to defend the capital, instead of Giuliani. He could have called the Department of Homeland Security, not the depraved Kevin McCarthy. He didn’t call on governors to get National Guard deployed.
If you are a Republican your representative was in danger. You think the mob may have just torn apart Democrats, but what would have happened if you representative was in the way, or wanted to stop this mob?

While it is a matter for some legal scholarly debate as to whether he engaged in insurrection prior to the march on the capitol, I believe his actions after the attack began qualify as participation.
For 187 minutes, Donald Trump sat and watched the events unfolding on TV, and did not act. His aides implored him to act. He did not. He laughed and was openly amused at what was occurring.
Regardless of what you may think about his role in the precipitation of the events, he purposely and willingly declined to act on an open insurrection. That lack of action qualifies as explicit participation. Failing to act on an insurrection that you would benefit from if it succeeded is taking part in said insurrection.
Right now Haley is the only other person actively pursuing the GOP nomination. The magats would never vote for a woman. The magats would never vote for a person of colour.
Can one of the other candidates redeclare their nomination (some white guy) and step in and win the race? Does anyone know what might happen in this situation?
Interesting tidbit for those who didn’t read the article, SCOTUS does not appear to be reviewing whether or nor he is an insurrectionist. That is a factual finding of the Colorado court and has itself been appealed.
They are reviewing whether the 14th Amendment applies to Trump, based on a technical reading of it that could mean that “The Office of the President” for which Presidents take the Oath of Office is not technically an “Office.”
Myriad legal scholars have said this will not stand any legal scrutiny whatsoever and of course President is an office and Congress in the 1800’s obviously have wanted Confederates barred from the Presidency among all other offices… but we’ll see.

As to whether “only Congress can enforce the provision”, that’s precisely what the Supreme Court is going to rule on. This strikes me as the legal equivalent of “you’re not the boss of me, Constitution!”, and I doubt SCOTUS will agree, but we’ll see.

Ignoring the fact that Trump’s lawyers don’t determine what SCOTUS should do, disenfranchising tens of millions of Americans is *exactly* what Trump’s fake electors scheme was intended to accomplish. Even if it were true, this is a pot-and-kettle situation.

– the former president called for the crowd to be there
– the former president knew some were armed
– the former president called for them to move to the capitol
– the former president said the words peacefully and fight like hell, in separate sentences. The constant hyperbole about final fight, last fight, etc, feeds into the aggressive verbiage there.
– on camera, live, his supporters were destroying windows, doors, pushing through barricades and punching and pushing officers.
– once in the building, officers and personnel directed our elected representatives away from the mob, and let the mob walk and do what they wanted. One officer was called a hero for leading them down another hallway from the hiding reps. I think he’s running for office now.
– the former president ignored the violence while watching it on TV. He was asked to stop it by saying something for hours. He didn’t. Eventually one of his aides did 3 hours later.

– Aside from the coercion of the GA, AZ, MI, PA folks which is on record, the whole plan is also on record.
– They intended to invalidate 4-6 of the swing states by the VP.
– They had false electors who sent in their votes.
– They needed the mob to delay the vote. They did.
– They needed Pence to decertify the official electors and allow state Governors to signify new ones. He didn’t. Plan failed.
That’s an attempt to subvert or overthrow the results of an election and peaceful transfer of power. No president has done this in the history of our nation, and nothing like it has happened since the civil war. I don’t know how Mr Trump would be eligible for any US office and I honestly don’t know how anyone could vote for him.
