Kid is getting to the age where a passport is being demanded by her mum. Going Irish passport due to that great thing called Brexit.

Was surprised by the Irish citizen craic, I thought it was just anywhere on the island as a general rule, I didn’t realise there was a time restriction?

Obviously all okay as I have an Irish passport so can go the parent route but curious why this is?

  1. There is no time restriction if the said kid was born there to at least one British/Irish parent.

The pre 2005 rule applies to those born there when Ireland was still Jus Soli and are automatically Irish citizens regardless of their parents Nationalities at the time of their birth.

They would also be Irish by descent if they were born abroad and their parent was born on the Island of Ireland before 2005.

  2. It had become an issue where people were coming to Ireland “on holiday” at the same time as their child was due, in order to give birth to an Irish (and European) citizen.

  3. They changed the law in 2005 to remove birthright citizenship. It was changed because pregnant people were coming to the UK on holiday and then visiting NI and getting citizenship without ever visiting the 26 counties.

  4. They closed the loophole after a referendum in 2004 as people were abusing it to move to Ireland
