This is referring to an “ex parte” hearing (without the defense counsel) over filings from back in December where Trump’s lawyers are basically asking for access to several highly-sensitive documents.
A normal judge would not even think about granting this, but if Cannon chooses to do so, the DOJ will inevitably appeal.
Joyce Vance, who is a former U.S. Attorney, has stated it may even be grounds to seek her recusal. Although that will require a very high bar for Smith to pursue.
