My partner is Australian and living in Scotland on a partner visa (on the basis of defacto marriage) and we have decided to get married officially. The forms seem to indicate that he has no appropriate immigration status to marry while in Scotland.

Does anyone know the rules about whether we will be prevented from marrying because he does not have settled status or a marriage visa?

  1. You likely won’t be prevented. Plenty of people get married on a YMV-T5 visa etc. You will just have to provide more information and the home office investigates a bit more thoroughly. The process takes longer but it’s not really a barrier.
