Voor informatie die reeds overal op het internet online stond, wauw. Belgische justitie is een grap!
Zijn ander type rechtszaken maar het verschil in boete is toch frappant.
400 euro voor Reuzegommers, 800 euro + 20 000 voor Acid.

Rechter had de straf moeten en kunnen opschorten. Proportionaliteit is ver zoek. Ik hoop dat hij in beroep gaat en dat ze hem daar vrijspreken.

Iemand moet mij is uitleggen waarom die reuzegommer en het restaurant nog steeds niet bij naam genoemd worden in de media? Dit is publieke informatie en wij mogen toch weten wie er hier eigenlijk een vordering instelt?

Als je rijke ouders hebt met politieke banden kun je doen wat je wilt.
Ik hoop dat Acid in beroep gaat.
Hmmmm…. Een milde tik op de vingers was duidelijk niet voldoende. Kijk ik begrijp best wel waarom die ouders een proces starten hieromtrent. Maar ik verwacht ook dat een rechter neutraal en proportioneel reageert…. Mocht ik Acid zijn zou ik het in beroep verder laten sudderen.

Some important caveats:
* This was a civil suit, the state didn’t prosecute him, instead it was the parents of a reuzegommer, those that own a restaurant, which sued him.
* He was convicted for ‘elektronische belaging’ which from what I can find, is akin to ‘cyber stalking’
This is kind of nuanced, but basically, it involves actions or a single action which have recurring repercussions on someone’s personal life. I have no doubt those mentioned in the video fit this description to some extent.
This law mostly seems meant for stalking offences though. Like planting apple airtag on people you’re stalking or hounding their social media or using software to spy and track them. It’s kind of weird to me it was used in this case, because it gets kind of close to journalism.
Journalists sometimes mention names/occupations of criminals, where is the legal line? Is it measured in terms of the usefulness for the public? Are you just legally protected as a journalist?
* The 20 000 is not a fine, it’s damages and they are the maximum, the victims in this case still need to show they suffered that damage.
The restaurant had an increase of false reservations and bad reviews after the video. I have no doubt they’ll be able to show damages.
In conclusion, I think it’s important for everyone to realize that in Belgium, at least when we’re not considering journalists, privacy and personal environment are protected quite heavily. Ordinary citizens don’t have the protected right to spread ‘public information’, I don’t think we really have that concept in our law. Even if everything you’re saying is true, you don’t have the right to spread/publish information that causes harm. Even if it’s all publicly available.
Just like ordinary citizens can’t just film/photograph whoever and whatever and publish it, even if it’s all recorded in public areas.
I think many people, myself included sometimes, have this warped view of free speech and all that based on US law/media/social media, etc…
Personally, I don’t like it. I think people deserve to know some things, as long as you don’t spread falsehoods or incite crimes, I don’t think only a certain class of people/companies should get to decide what information is and isn’t relevant.

What the hell. I don’t like Acid at all, he’s honestly an annoying brat. But I did expect some proportionality here, especially with all the media-attention around this entire lawsuit.
Het probleem voor mij is niet dat hij schuldig is en een straf krijgt, want dat zal waarschijnlijk volgens de letter van de wet zijn. Het probleem is dat er dagelijks zoveel zwaardere feiten amper zwaarder bestraft worden. Al die zedenfeiten dat hier wekelijks gepost worden waarbij daders ook maar een celstraf met uitstel krijgen en geen 20k schadevergoeding moeten betalen… Hallucinant
De strafmaat is het probleem niet. Het gebrek aan strafmaat voor veel andere en zwaardere feiten, ondanks die volgens het wetboek zwaarder zouden moeten bestraft worden en de combinatie met dik nepotisme,is het probleem. Tijd om het justitiepaleis in brand te steken op een feestdag, wanneer niemand aanwezig is. Om te beginnen (en geen slachtoffers te maken). Dit blijft duren zolang er niemand opstaat.
Het mag dan wel allemaal juridisch uit te leggen zijn, dit **voelt** onjuist aan.
Wat een apenland en een rechtsysteem van kust te kl…. België waar geld belangrijker is dan een mensenleven!!!
Geen fan van die man, maar toch leuk dat het contrast tussen bepaalde misdrijven qua veroordeling getoond wordt.
Iemand de dood in helpen / u vergrijpen aan iemand is afhankelijk van de rechter minder erg dan een privacy inbreuk.
Hij had beter “per ongeluk” iemand vermoord of een minderjarige verkracht, dan was hij er beter vanaf
