I’m going to assume that “legal for same sex couples” just means that the law is worded without homosexual relations in mind. This is also often the case with rape laws that are worded such that only PIV sex is defined to be rape.
Places where it is legal I would imagine mean there’s just no explicit law that bans it. I would wager that most of these countries have other laws that label incestuous relationships as some sort of abuse or assault.
People often think incest laws exist to prevent birth defects but it is very much just to forbid people in a position of power (e.g. parent or older sibling) from taking advantage of vulnerable and/or dependant family members.
