Missouri law says pregnant women can’t get divorced

  2. This, unfortunately, isn’t new. Maybe for Missouri, but as far as I am aware – this is a common enough law in the south. Or was, at least. The sick thing is – pregnant women are among the women most likely to be murdered (correct me if I’m wrong) and its usually by their significant others. As per usual, laws like these save no one…And certainly not families.

    My own mother couldn’t divorce her abuser because she was pregnant at the time. This was in 2004. Not Missouri though. But the fact this outdated bullshit is still around in at least two states is fucked regardless.

  4. Had a buddy go through this in Kentucky a few years ago. He wanted out but couldn’t get it finalized until his daughter was born.

  6. It looks like there are a handful of states that won’t finalize a divorce while there is a pregnancy and several other states where it is the judge’s discretion to allow it. If it is allowed, there will likely be additional required court appearances after the birth to deal with parenting and custody issues.

  7. After another round of maga “leadership,” expect Missouri law to say women aren’t allowed to get divorced – not for any reason. That’s the christo-fascist ideal of the boomers and their gen X progeny. And as we all well know, that’s just the iceberg tip of the nightmare.

  12. There are several states where this is law, unfortunately.

    I’m about to pop with our next child, and was recently filling out the birth certificate paperwork so it’s ready to go. In my state, if you’re divorced but the divorce was less than 300 days before the birth, your ex husband is legally presumed to be the father of your child. Regardless of who actually is the father. There are several paragraphs within the form explaining this.

    My husband and I are happily married, and he is definitely the father of this child. But reading that distinction felt rather invasive, and much like an overreach of our state government.

  14. The law probably isn’t as deep as y’all are making it out to be. They can obviously still separate.

    They can’t finalize the divorce because it is impossible to fashion a parenting plan for an unborn child. They can absolutely file for divorce and separate from their spouse.

  20. I dunno, seems like in the black and white eyes of the law a pregnant woman might not be entitled to the same child support as a woman with a kid.

  21. This is horrible! I’m sure many people would rather not get married than deal with this bullshit. This is why we need more women in politics, because leaving power in the hands of men set up for very destructive and one-sided backlash.
