  1. Summary –

Lord Sandison ruled that as other members of the public could have seen the matches, “the first pursuer’s copyright in the graphics displayed in the course of the broadcasts” had been infringed. He granted an interdict against a repeat of the scheme.

He ruled that Sky had not shown that it had suffered losses as a result. On the question of damages, he added: “None of the court’s orders in this case will be pronounced in its [Sky’s] favour.”

A Sky spokesman said: “The premises did not have permission to show Sky Sports. We are pleased that the court has agreed with our position and found in our favour.”

So guilty in a small way but Sky were taking the piss with their contention regarding losses.

So no monitor allowed, but what about laptops or other mobile devices watched by more than one person in a public place?

  2. I wonder if this means pubs will just let anyone sit there and watch matches on their own phones. It’s not like it’s much worse. Just announce a “we’re watching the Manchester Derby this Saturday” event and people can still have a drink while wearing their kit and watching the game together.

  3. ‘Yes mate don’t bloody let the customers set up a monitor for you and play the match, but I agree sky take the piss with their prices so fuck em’

  4. Not a bad idea, I don’t think you can really enforce copyright on the general public watching something outside their home because at what point could you really classify it as illegal unless the building specifically disallows it

  5. I’ve been in a wetherspoons watching on a tablet many a time

  6. >after baulking at a £1,300 per month quote to subscribe to Sky Sports.

    What the fuck

  7. Between the page title, subheading and image description before I enabled JS I genuinely thought it was satire. Had to be a Scotsman. Fair play you northern savage.

I’m not versed in Scottish law but I think the judge ruled well, any other way could have some serious implications for a lot of Scottish businesses.

    >resembled a flat screen TV, and allowed it to be displayed in a prominent place.

That leaves a lot of wiggle room, like aye lads. Carting down your 42″ “gaming” monitor and positioning it in a way where passerby’s can see you’re watching football takes the piss a wee bit. However…If you was to bring in a portable ~20″ monitor and put it on the table you’re drinking at then….

The cherry on top is Sky’s PR quote
    >[..]We are pleased that the court has agreed with our position and found in our favour.

They didn’t except from a technical stand point and its just cost you 5+ figures in PAYE & solicitor fees not to mention you’ve just pissed off most of Dundee and now it’s made national news. The pub owners just got some fantastic marketing for less than a grand, pretty sure that’s called an own goal.

  8. Was in a pub the other month when Amazon prime games were on and it was 90% people huddled around tables watching on their mobiles.

    Was quite the sight.
