The new immigration law has a new rule that people with Blue Cards (or similar) can bring their parents, given that their first residence is on 01. March 2024 or after.

What isn’t clear is whether the requirement is first “residence permit” on 01 march or first “work permit”.

This is the wording of the law:
> „(3) Den Eltern eines Ausländers, dem am oder nach dem 1. März 2024 erstmals eine Blaue Karte EU, eine ICT-Karte oder eine Mobiler-ICT-Karte oder ein Aufenthaltstitel nach den §§ 18a, 18b, 18c Absatz 3, den §§ 18d, 18f, 19c Absatz 1 für eine Beschäftigung als leitender Angestellter, als Führungskraft, als Unternehmensspezialist, als Wissenschaftler, als Gastwissenschaftler, als Ingenieur oder Techniker im Forschungsteam eines Gastwissenschaftlers oder als Lehrkraft, nach § 19c Absatz 2 oder 4 Satz 1 oder § 21 erteilt wird, kann eine Aufenthaltserlaubnis zum Familiennachzug erteilt werden; dies gilt auch für die Eltern des Ehegatten, wenn dieser sich dauerhaft im Bundesgebiet aufhält. Die Aufenthaltserlaubnis nach Satz 1 kann nur erteilt werden, wenn die Voraussetzung nach § 5 Absatz 1 Nummer 1 erfüllt ist.”

I’m was working on my student permit, I then worked on my job seeker permit, then applied for a blue card on the 1st of March in the hope of meeting the criteria. But I’m not sure if i meet them here.

A person familiar with this talkes about it in [this](https://youtu.be/ITg_CYzfcOA?si=jwMKyjuFpvRvMHeq) video and says the criteria is first work permit, and thus students (or job seekers) who apply for work on 1 march are eligible.

This [post](https://www.instagram.com/reel/C3-wiCVsmMH/) from Johanna Rüdiger says differently. She says the criteria is that you come on or after the 1st of March.

> Facilitated family reunification for skilled workers: Spouses or minor children moving to Germany to join certain skilled workers will no longer be required to provide proof of sufficient living space. In addition, these skilled workers will also be able to bring their parents and – if the spouse is also a permanent resident of Germany – their parents-in-law to join them if they receive their residence permit for the first time on or after 1 March 2024.

Which suggests first residence permit and not first work permit.

Does anyone who is correct here? Is it the first work permit or first residence permit on 1st of March 2024.

In other words, if a student who graduated from Germany and then started work with a blue card on 1st of march 2024, is he eligible for this kind of family reunification?
