I leave in the Netherlands. I had a letter from **Landeshauptstadt Düsseldorf Ordnungsamt** saying that I

“Overtreden wettelijke bepaling: artikel § 37 Abs. 2, § 49 StVO; § 24 Abs. 1, 3 Nr. 5, § 25 SIVG; 132.3 BKat; § 4 Abs. 1 BKatV

Bewijsmiddelen: lasermeting

Voor zover voor de vaststelling van de overtreding en meetapparaat is gebruikt, wordt bevestigd dat dit geijkt was. De geldboete voor deze verkeersovertreding bedraagt volgens het Duitse tariefstelsel voor geldboetes (BKatV) als regel 400,00 EUR. Als betrokkene dient u bovendien de kosten en onkosten van tenminste 28,50 EUR te voldoen. Indien u de verkeersovertreding toegeeft, kunt u het vermoedelijke totaalbedrag van 428,50 EUR al vooraf op de genoemde rekening (onder vermelding van dossiernummer en autokenteken) overmaken.”

So in English, it is: “Means of evidence: laser measurement To the extent that a measuring device was used to determine the violation, it is confirmed that it was calibrated. The fine for this traffic violation is generally EUR 400.00 according to the German tariff system for fines (BKatV). As the person involved, you must also pay the costs and expenses of at least EUR 28.50. There are two photos showing that the car is in motion.

From the photos, I see some white dots on the traffic lambs. From that, I assume that they fined me as if I was coming from that direction (Red line in the uploaded picture). But, actually I made a left turn in the crossroads and continued (Green line in the uploaded picture).

Do you think is this something I can object? This conjunction is close to Düsseldorf airport. I can prove that 4 minutes before they took the pictures of me, I made a payment at the airport.

P.S. For some reason I couldn’t upload the photo. My direction was from Düsseldorf airport to Düsseldorf center. So from this angle in the link, I came from the right side (where two cars and the motorbike wait in the picture) and I was going with the same direction as the white van and the other two cars.

  2. Of course it is worth appealing if you did not commit the infraction, even better if you can prove you did not do it. For 400 euro it must be a serious speed violation. But if you drove too fast you should pay.
