I am a bit confused with this part of my rental contract, so is it a limited contract?

  1. I’m not a lawyer but that doesn’t seem legitimate. Get professional help from Verbraucherzentrale, Mieterverein or a Fachanwalt für Mietrecht.

  2. It says the contract ends in 13 months. But it extends automatically to the end of next April/September over and over, if not quit before.

    I don’t know if that’s legal, but this looks like a contract for students, as it’s aligned to Semesters

  3. You have to rent for at least 13 months open ended, but you have to give notice one year before leaving, while your landlord can kick you out every year. That is not legal for a “Einseitiges Handelsgeschäft” and for a “Privatgeschäft”. That means its only legal if you AND the landlord are registered businessmen aka. (Kaufleute) or represent a company. But i wouldnt complain, as you either get a flat, which is hard to acchieve, or you dont and thats it. The landlord will probably not kick you out if you aint no annoyance to him.
