Hey guys! This has been haunting me for 2 years now and I’m desperate.
For context, I lived in Germany from September 2021 to March 2023. I signed up for McFit in September and cancelled in November 2021.
After around 6 months i received the first email from McFit saying I hadn't paid for the past months (even though I canceled before) and since I was still living in Pforzheim at this time I personally went to McFit again (with my friend so he is a witness to all of this) and told the person there about this situation and she confirmed that I canceled and sent a form to the Berlin team and said everything was solved (but unfortunately I did not get any physical or digital confirmation from her on this day).
After that I received emails again asking me to pay and I tried to contact McFit multiple times through their online form and no one ever got back to me (and I was forced to use this form because they don’t provide any email or phone number).
Then, after ALMOST A YEAR, in May 2023 I get an email from a debt collecter company in the name of McFit, asking me for the money again, I explained the situation one more time, and sent the proof of cancellation of November 2021 and this person replies to me that the email I used happen to not be valid and that’s why they didn’t cancel the subscription. Now at the time, I was given this email by the reception person at the gym and when I sent the email I did not receive any indication that it wasn’t valid.
I then sent my final email (which you find in the first picture i attach here) in May last year and I never heard back from them again, which made me think that they had finally dropped the case.
Today, I received another email (also attached) saying that they were responding to an email I sent in December 2023 (this already makes no sense because the last thing I sent them was in May 2023) and not reacting at all to my previous claims and they are just demanding the money due next week April 5th.
Also to note that the amount is 239€, so it’s not worth to get a lawyer involved.
I honestly don’t know what to do anymore, I’m not even sure if what they keep doing is legal since they have been harassing me with this money since June 2022.
What do you think should be my next step?

Send them an Email with one sentence. I have a good and extrem pissed off Lawyer.
My gf had the similar trouble with FitX during corona and after like 4 month of mailing forth and back, she asked me for help and i send one short Mail wich included the Word lawyer and sue.
3 days later my GF got the money back what they booked from her Bank Account after Quittung the contract.
Fr in germany the magic key to most situations that are similar to yours is: Lawyer.
Most companys just want to see how far they can get with stuff like this because the vast majority just pays instead of looking into it and taking legal Action. Be it DSL- Provider, Local Power Companys, Gyms or even Car mechanics.
