Is this also the case in Poland, for example with a apartment rental contract?

  1. No lawyer will guess the outcome or even possible legal path without details.

    That being said, go to an actual one, it will be worth it. Landlords tend to become reasonable when they receive pre-proceeding documents.

  2. Hello, since I didn’t really give any details, here is some more information. Thanks in advance.

    I have been living in my apartment since August 2023. The apartment is a single apartment that has been converted into two. It has one set of meters for both. It is a 48m2 apartment. The landlord stays downstairs, but not the entire month. He is there on weekends and Wednesdays, more so in the winter than summer. He claims 30% of usage is from him. He has s couple of solar panels above his balcony.

    The contract specifically states that utilities like gas, electric, water, will be billed according to usage. I will make the advance payments, and then settle after 6 months. However, the landlord has since admitted to me that he is unable to provide accurate usage. He has tried to increase my admin/utilities price several times now.

    The meter showed from August to February 3000+ kwh was used. Taking 30% away that would leave around 2100 accused of me using. That would be 350kwh a month, 11.6 a day.

    I was living alone until February, then my girlfriend moved in. She was here on weekends and stuff. From August to December I only mainly used the TV and playstation 5. Then the obvious cooking, laundry, dishwasher, lights. After December I got a gaming PC, but with the games I play it uses even less than the TV and ps5.

    I am home more than most, but I am not using these things all day. Oven and induction stovetop use a lot when in use, but they are not used for more than an hour. We use kettle a few times a day, but it would take ten uses for 1kwh. I bought two energy monitors for the TV/Ps5 outlet and the PC outlet. In total for a month and a half they have used 140kwh. That would mean laundry, lights, dishwasher, cooking, kettle, is eating up 250-300? The numbers don’t make sense to me.

    My point is, I have no idea where all this energy use is coming from, he can’t provide me with accurate readings to tell me if its actually coming from me, and yet he has asked for more money several times due to it.

    It got to the point where I started reaching out to lawyers, but they tell me that even though that part of the contract is false, it wouldn’t void the rest of the contract. I know they are lawyers and the experts, but it just doesn’t make sense to me how an outright lie can be written into a contract and it doesn’t void the entire thing. It was written knowing it was false. I hired one and he is going to work on settling a termination of the contract. However, when I informed the landlord of the fact that I hired a lawyer, he wanted to come chat and went back down to the price we agreed on after my fiance moved in. He said if we decide to leave, we are still liable to pay. We would still like to just find another place, but if we have absolutely no other choice it is only 4 more months. I still wanted to get some input from others even though I hired a lawyer, so that is why I posted.

    I want to pay for what I use, but I can’t actually see what I use.
