I had a situation with my workplace, they fired me, I was to arbeitsgericht and made a complain, after the work said sorry and that the kundigung is not valid, I withdrew the complain from the arbeitsgericht and got this confirmation in the post : Der Gegenstandswert ware auf 7287 euro festzusetzen. Es wird davon ausgegangen, dass eine formliche Festsetzung zunachst entbehrlich ist

I don’t understand what is with the money, who needs to pay that? It’s very strange to me. Please help me understand it

  2. Fees for certain court procedures as well as lawyer fees are based on the *value of the claim*, the amount or equivalent value that the parties involved are arguing about.

    The letter says that *this* amount is 7287 Euros.

  3. I am not a lawyer, but let me attempt to explain: In general, the courts efforts have to get paied as well as the lawyers efforts. The amount of payment depends on what the “value” (Gegenstandswert or Streitwert) of the case is, so (for example) claiming 10.000€ of satisfaction will be more expensive than claiming 1000€.

    The court calculated the value of your case to 7287€. Furthermore, they state that they think that for now this needs not to get fixed officially.

    I understand these sentences as informative, they do not set directly a fee for you to pay, but maybe there is more text in the letter that sets the cost for you (should be a fraction of the Gegenstandswert). These lines may also be relevant for your attorney to calculate his payment (regardless who has to pay for it)

  4. If a court wants you to pay things, they will state that clearly and unambigiously, usually accompanied by a deadline and information on how to pay. This is informational, as others have stated. As a layman, I would also have scratched my head a bit as to why they are mentioning “Gegenstandswert” at this juncture…

  5. I looked at your photo and the letter confirms that you withdrew your complaint and therefore the court appointment will be cancelled. If it had taken place the sum that was in question would have been the 7.000 Euros. So it’s just a very complicated way of saying the case has been dismissed because you withdrew your complaint. I don’t think anything else needs to be done.

  6. You don’t have to pay anything at this point. If the government wants money from you, they let you know.
