I love the criticism of his defence team’s ‘victim blaming’ (more accurately ‘accuser discrediting’) strategy. If a defendant with bottomless funding who maintains his innocence asks his people to ‘go easy’ on the accuser, is that going to interpreted as a) a noble and sympathetic gesture to minimise further distress to a confused/deluded woman, even if it weakens his defence, or b) a tacit admission of guilt?
Allowing a defendant to demand access to private mental health records of an accuser is extremely damaging to the condition of trust required between the victim and their doctor/therapist. This relationship of trust is undermined completely if there is a possibility that a victim’s records may be used against them. I don’t know if this is common or whether mental health records are protected in any way but this strikes me as deeply concerning.
What has happened to innocent until proven guilty why don’t we just shut up about this case and wait to see what happens
