I think Martin Nolan is wrong, if I’m honest. I don’t think it’s even a little bit unusual for sex cases to lie about what they thought was going on in the interaction.
In my opinion, they pretty much all lie about being all confused.
It’s remarkable that this confusion was between a grown man and a teenager rather than a grown man and another grown man who could have bet the head off him.
Judge Nolan needs his internet activity monitored and his hard drives checked.
Who appoints Nolans as judges? When I’m minister for justice – and that will be no time soon – my first law will be throwing CVs applying for any court position from anyone called Nolan in the bin.

I know the defending solicitor has their job to do and being drunk or it being dark shouldn’t be a valid excuse accepted by a judge. Sexual assault is sexual assault, and even worse it was a teenager. Can we put together a collection of these ridiculously lenient sentences to see what judges are handing these out (like Nolan)? Anyone in law able to say how they compare with other judges or other countries? By Christ we need to do *something*.

People always ask survivors why the didn’t report, but when you see these stories you have to wonder why anyone bothers at all.
Getting a case to court takes a lot of time and people have to repeat their story over and over again and it retramuatises them. And for what?

There needs to be some kind of active monitoring and benchmarking of sentencing patterns by a committee of the judiciary and legal profession themselves. It doesn’t need to undermine judicial independence, but the system is clearly lacking a structure that self checks and balances.

I’m sorry, but I fail to understand how anyone would think it acceptable for the guy to grope any person’s genitals, no matter how drunk they were, no matter how dark it was and no matter what age he thought the person was.
Under any circumstances, it’s a gross violation.
Not understanding the language is not a valid excuse.
Being drunk is not an excuse.
Being from a different culture is not an excuse. There is no excuse for sexual assault, ever.
To think it was a 16-year old kid, it’s just beyond belief.
Clear signals need to be sent that sexual assault, abuse and rape are very serious crimes and they will not be tolerated.
Those signals are not sent by giving someone a suspended sentence.
