








Screenshots are self explanatory, but long story short : at the entrance of the building it was a note that inspection for smoke detectors would come on certain date between 11-13. My landlord never installed them even tho she should have done it before I moved in, but she left other unfinished work in apartment as well that she said she’ll eventually finish( she never did). She got inside of my apartment without me knowing to install them and now treating that she will kick me out because I was not there.

Change the locks to your apartment and personally I would avoid such long discussions on Whatsapp. Leads to nowhere.

The termination talk if she has to discuss the problem any further is ridiculous.

As others have said: Change the lock to your appartment’s entrance door. Look on YouTube how to change and measure a *Zylinder* of a *Türschloss*.
Your landlord was never allowed to keep a key to your appartment, so don’t expect him, to hand out all the keys, just because you are requesting it.

So go to the police and file charges. This is a criminal matter. “Hausfriedensbruch”.
Also you have to have acces to the trashcans 24/7. If that is not possible you can lower your rent by x% do that only with a lawyer.

First of all: your landlord is an asshole and completely wrong. The law is on your side, a landlord is not allowed to enter your apartment without permission or without an emergency.

Evicting a tenant in germany is not as easy as your landlord is trying to make you believe. Evicting a tenant can take years over years, because a tenant has rights!!
Besides of that, change the locks, and follow the complaints – for the moment.

I would set a date when he has to give you all the keys otherwise you will talk to your lawyer. If he thinks about cancelling your contract tell him all Communication via WhatsApp will go to your lawyer.
You do not need to do that. Just telling someone you will is enough.
Of course an insurance will not require you to keep your tenants 2nd key
And don’t forget that your landlord has already broken the law by keeping a key to the apartment. They need to either hand you all keys at the ubergabe or allow you to install your own lock.

Wow I am so glad you didn’t take this lightly despite her assurance of how good it is for you. In my initial years as a student (and even now sometimes), I never had in me to protest against trespassing from past landlords even if I didn’t like.

Go to the police. It’s likely that the landlord as well as the contractor have committed a crime. Also get help from a lawyer to check if there has been any breach of contract from your side by not providing access and if a notice posted in the house is sufficient to ask you for such access. Do change the locks though
You can start a lawsuit against you landlord and would win this. This is hogly illegal and you are absolutely right. He has to do an appointment with you and not do it the way he described.

I’ve had a similar landlady which was absolutely ridiculous.
First you have to understand that you will never change these idiots. They think of themselves as someone better since they own the place. They do not understand you are a customer and you should be treated well. There are multiple examples where ppl are not paying rent or rly destroying the place.
What did I do in your situation? I also texted with that psychopath of a landlady and it was an absolute waste of time. If you rly want to defend yourself take a lawyer as another one did in my old building. He spent 3 years on court with her, investing energy and money. Was not an option for me even if I was right.
Instead I moved out and focused on building a home where I feel well. I am happy that I don’t have to talk to that btch anymore.

If you consider to press charges for trespassing, you need to make that decision within 3 months of that day, because that charge is contingent on your written and signed “Strafantrag”.

while yes he has to check and maintine the smokedectors by law. he not allowed to enter you appament with out you allownce or with out informaing you per post. infom you laywer smells fishy.

You should today (!) join a Mietverein and think about a lawyer insurance (rechtschutzversicherung) for tenants. Normally you have to wait 3 months until you can use them, but really, with that landlord, you are going to need it. Better apply for Mietschutzverein today online and look into Rechtschutzversicherung for tennants right away

So first the dude comes in unannounced and unallowed with a key he shouldn’t have, but he has the fucking Unobtanium balls to make a comment about… empty bottles? Once he’s backed into a corner of “You fucked up. fix it.”

I really hope you find that family heritage Rolex that went missing since your landlord broke into your home. Would be a shame if not. Eventually ask the landlord if she has seen it, as she was the last one with it in your apartment without your knowledge and you have proof (WhatsApp messages).

I had exactly the same case a few years ago. Old smoke detectors were to be replaced by a company on behalf of the landlord. I wasn’t at home either and when I returned from work I saw that my apartment was messy (dust and dirt from drilling, furniture being moved), new smoke detectors had been installed and even a tube of glue had been forgotten by the company. Turns out the janitor unbeknownst to all has keys for ALL the apartments and opened the doors if nobody was home.
I called the police on this matter. The operator was understanding but the police officers on site were very disinterested and told me that they couldn’t do anything (more they didn’t want to do anything) after all there was a note in the hallway. It doesn’t get any German than that. By the way, the note wasn’t even laminated. Didn’t even take names and everything and left after 5 minutes.
That completely shattered my trust in anything. The situation itself is trivial if you look at it from the outside, but the violation of your own home and the complete helplessness is awful.

Check out if some Mieter Verein close to u provides a rechtsschutzversicherung to their members and join them as soon as possible. If u get in trouble and just then join, it might not serve u yet.
We had a landlady who would just walk in anytime, so I installed an indoor latch that locked the door from the inside. If we were home she wasn’t getting in and it drove her crazy!
First things first change the lock! That’s your right. Your landlord is legally obligated to hand over every single key to your apartment.
After that, you should join the “Mieterschutzbund” or get some kind of “Rechtschutzversicherunf für Mietrecht”.
And you can file a police report for that. What your landlord did is an actual criminal offense. He is not allowed to enter your apartment if there is no emergency. Even if he owns the building.
