I bought a used but in great condition item on ebay kleinanzeigen a couple weeks ago, which unfortunately arrived broken and with some pieces missing. I contacted the seller with lots of pictures immediately and it seems like it broke in transit, but they insisted that no parts were missing. I read online that if that happens, it's between the seller and the shipping company, so I asked the seller to please take the product back and refund me.

They proceeded to tell me they packed it correctly, although I had pictures to show they didn't. There was no padding in the package and the product and all its tiny pieces were moving freely, so it got damaged. They told me they won't accept the delivery, so I opened a case with PayPal (and told the seller), who proceeded to ignore both of us. I had paid with buyer protection (I covered the extra 1,5 euros for the fee).

After over 10 days of no response, PayPal ruled in my favor and gave me the money back. The seller later contacted me and asked for the product back, to which I replied no problem, if they cover the shipping cost. I expect it to be around 5-6 euros plus another 2-3 for a new box.

I would normally just send it back on my expense, but this time I'm very annoyed because they treated me very poorly, lied to my face about the missing parts and ignored me, although I had many pictures and was polite and responsive the entire time.

  1. Just reiterate on what you said (copy and paste). They can make all the legal threats they want, but from your description it doesn’t seem like they have a case.

  2. 99.9% of all “I’M GONNA REPORT YOU TO THE POLICE FOR FRAUD!!!!!” bullshit is an empty threat. If you have everything properly documented with photos I wouldn’t worry about that and just ignore them and that novel they wrote. You already told them you’re willing to send it back if they pay for the shipping, which seems fair.

    Generally I would expect someone to send a parcel with included insurance (e.g. pretty much all of DHL *Pakete* are automatically insured to at least 500 €), unless there was another specific and explicit agreement, e.g. shipping via *Päckchen* to save costs, so it would be the sender’s responsibility to be reimbursed in case of any damages during transport.

    If you just want to be left alone, bite the bullet and just send it back, it’s your decision, but I don’t think you would be obliged to do so in any way.

    I would send it back, but not when the other person is behaving like that.

    You are slightly wrong.

    The “Its on the seller” applies only to a comercial seller. Sellers on Kleinanzeigen are private. They fullfilled their duty by sending you the item. This does not resolve the seller from a lousy packaging.

    You open a case with PP and state the item is not functioning/broken/Not matching the description. (Which you did)

    They rule in your favor, and now the seller can pay you to send the item back. The shipping in this case is on the seller.

    If you send it back, make sure you use a tracked shipping method.

    Send them a last email, in which you give them around 14 days to transfer you the money for the shipment, or you will dispose the item AFTER the deadline passes. No more replies are needed after this.

    P.s. NEVER use “Päckchen” – Non tracked and non insured
