
I had joined Prime Time fitness gym in May 2023 for 3 months & they offered 2 months of additional free membership, so total 5 months. For this duration, I agreed to pay 65 euros per month and 100 euros of starting fee for the membership. I have the copy of the agreement to prove these details. Please note that they did not charge me anything till now even though I provided them the correct SEPA details.
Then, in July 2023, I cancelled my contract with them in person at the gym where I enrolled. However, they didn’t provide anything in return as a receipt.
They didn’t communicate with me since July 2023 at all, but now suddenly I checked my spam folder and found emails from them since March 2024 that I have to pay 900 euros. Logically, I should be paying only (65*3 months)+100=295 euros but my thinking is that they are charging me for the whole 1 year. I have sent an email to them to explain the reason for the charges but did not receive any reply. I have the following questions for the group:
- How should I further communicate my issues with the gym?
- What should be my next steps in dealing with this situation?

As per the contract you signed, cancelling the gym membership is only possible **in writing**. If you can’t prove that you cancelled the gym contract in writing, then the contract will automatically be extended by an extra month. If you cancelled it in-person and they didn’t process it, then it will be difficult now to prove retroactively. You can go back to the gym and speak to them, but they will most likely demand full payment from April 2023 until now. Gyms are notorious for this. You should resolve this ASAP, otherwise they will involve a debt collection agency to collect the money from you and it will become more expensive.
