  1. I don’t know anything at all about Richard O’Halloran, so will spend some time looking into it tonight, but I just had to say that the comments in that thread are fucking atrocious.

    It’s not even the racism towards the Irish that’s appalling, it’s the complete lack of imagination and drivel being said.

    I have no problem with slurs against the Irish when they’re funny, but just saying nonsense like “forgot his lucky charms” or “must have been drunk and forgot his bar tab” are so bland and uninspired it’s offensive.

  4. Ireland doesn’t have a great deal of diplomatic clout so there isn’t a whole lot they can do with regards a juggernaut like China.

  5. If Israel did this people would be going apeshit. We’re very choosy about the injustices we feel passionate for, at government level and amongst the general public.

    Don’t hear much about boycotting China, whose treatment of Uighur Muslims is comparable to the level of oppression Palestinians face.

We support celebrities like John Cena and LeBron James who suck up to China. The WHO doesn’t even acknowledge Taiwan because they want to appease China. So I’m not surprised in the slightest about this news

  7. China was holding a couple of Canadians hostage for a long time too, Michael Kovrig and Michael Spavor, in retaliation for a Chinese executive who had been arrested in Vancouver. They had nothing at all to do with her, they were just a couple of random Canadians who conveniently happened to be in China at the time she was arrested.

    Eventually she reached a plea deal after an enormous amount of diplomatic back and forth between Canada, China, and the USA and the two Michaels were released shortly afterwards. That was a few months ago.

    I think China might be hesitant to treat an American citizen that way, though I can’t be confident one way or the other. One thing I’m sure of is that no citizen of a small country is safe traveling to China.

I feel like I’m in a unique position to comment, as I’m Irish working as a lawyer in Shanghai, and have also completed a LL.M in Chinese Corporate Law, my thesis was on the Chinese implementation of Corporate Criminal Liability. I’ve also been following his case closely for the past few years.

    Unfortunatley for Richard, China takes the approach of dual liability, liability for the company but also applying the liability to the senior managment of the company. From my understanding Richard was asked to come to China to resolve the irregularities with company and he evidently failed to get the proper legal advice before going.

    The company has an order against it to return the funds raised illegally to the “victims” and until that outstanding order is resolved the managment of the firm will be subjected to travel bans, prevented from using bullet trains or any “luxurious” spending. If he were a Chinese national the same would apply, however he is Irish and undoubtedly leave the country if he could, so until this matter is resolved the Chinese are refusing to grant him permission to leave the country.

    There’s no shortage of awful things China does, but on the face of it, this is actually “just” in accordance with the law, and the solution to the lifting of the travel ban is clear. It’s also why there is no diplomatic solution and the language of him being held hostage is not accurate.
