Hello, I’m French and got a phone plan when I moved to Germany a year ago with a company that replaces M&M with numbers, and misread that the period before you could get out of the contract was 1 year. I’m now trying to change this contract, but the guy I called to cancel it told me that the contract was automatically renewed for a year since I didn’t cancel it when the first year ended, and I cannot get out until the next year.
There’s a possibility to reduce the price, but I would like to get out legally. Is the seller’s statement accurate ? [Those are the details](https://mobile.1und1.de/details-all-net-flat-preisliste?chosenTariff=anf-s&chosenNet=e3&lightbox=true) , do they have a leg to stand on ? Also I read [this article](https://www.stuttgarter-nachrichten.de/inhalt.monatliche-kuendigungsfrist-handyvertrag-mhsd.bae05362-837b-496e-b47d-35098ae5d387.html?fbclid=IwAR2hXROiwCXdefsKCMBjjtt0T_iTbrPm_lFu6j6ZDtuLcwkOc6af5YJ8Nms) stating that a provider cannot lock for more than a year anymore, can I use this to get out of my contract and how ?
Thank you for your help
edit: here’s the official statement http://www.gesetze-im-internet.de/tkg_2021/BJNR185810021.html , [an article about it](https://www.verbraucherzentrale.de/aktuelle-meldungen/digitale-welt/wichtige-neue-kundenrechte-fuer-telefon-handy-und-internetvertraege-65879) (control F for Vertragslaufzeit und Kündigung ) but that does not explain how to force the hand of the provider
edit: PROBLEM SOLVED! So after contacting their services, it was confirmed that this possibility exist. For future reader, you must specify that you want to apply this one month period (not done by default, and the contact obviously won’t tell you it’s possible unless you specifically ask for it), and it’s only possible if your current contract’s first period ended and was renewed. I did it by phone but it’s also possible by mail. Careful, if something changes in your contract it might be a new one with a new period.

are you sure you linked the right contract? the one you linked (1&1 AllNet flat LTE S) is for 24 months (which btw is still egal after the law change you mentioned), not 12
I think with the new telecommunications law contracts can only be renewed for one month not for a whole year anymore.
This should also be valid for existing contracts.
Sorry for not having a source at hand. I might look for it later.
“Ein weiterer Passus des überarbeiteten Telekommunikationsgesetzes besagt, dass Verträge nach Ablauf ihrer Mindestvertragslaufzeiten nicht mehr automatisch um ein oder zwei Jahre verlängert werden sollen, sondern stattdessen danach einfach monatlich gekündigt werden dürfen.”
