  4. Still seems to give the appearance of a conflict of interest. Just like Clarence’s insurrectionist spouse does for him. And obviously much worse than the appearance of a conflict of interest caused by two prosecutors sleeping together or the employment of a judge’s child. But alas, these idiotic republicans will continue to kick and scream and cry about being the perpetual victims.

    His story stinks. Somehow the ‘school bus stop’ angle Alito quoted has now been scrubbed (since they weren’t running in January 2021), and considers the upside down flag a ‘normal’ response. I don’t know where they are living, but no where is an upside down flag ever a normal response.

    I get the neighbors are afraid of reprisals, but come on.

  7. And since his esteemed position as SCOTUS justice makes him above the law and immune from oversight, he never has to answer a follow up question:

    *How is flying the American flag upside down supposed to be interpreted as a commentary on the signage in your neighbor’s yard?*

    They don’t have to answer for anything. They make their own rules and decide for themselves if they’ve broken them.

  13. I think one of the big things history books will talk about of this time is how the conduct of the Supreme Court eroded the people’s confidence in it. The scandals concerning extravagant (and largely unreported) gifts to Thomas in order to curry influence, the clearly horrible things his wife got away with, the illegitimate refusal to confirm Obama’s pick a year and a half before an election, and yet slamming through Barrett while an election was ALREADY IN PROCESS via mail-in ballots, now this gem. For too long we’ve relied on tradition and decorum to do the job that laws and consequences need to. Enough with no accountability for the highest court, they need to be removable too.

  17. Their wives. The reason Alito and Thomas so strongly favour laws that control women, cause they can’t control their own. Poor guy, she wouldn’t even let him take it down. And so selfish, she clearly doesn’t care about his legacy or weighty office that he holds. There is just nothing he could do to fix it

  18. Nothing will come of this but I love that the timing of this is just before Alito is expected to be voting on the immunity case. At least he will be seen for what he really is if he votes against and then hopefully smeared by the news for the next several months like Thomas. I like to see him sniveling too.

  20. I think it would be appropriate to require that justices on the Supreme Court appear in public inquests once per year, just to remind them that they are not untouchable beings above the rest of us.

  21. Anyone (left or right) who flies the flag upside down when there is no “dire distress” and “extreme danger” to “life and property” is literally “disrespecting” the flag per U.S. Flag Code.

    As an American and veteran I find the politicization of our flag shameful. I know I’m swimming against the tide but it’s just plain wrong. It’s literally the only thing we have that we should all feel proud of and agree upon.

    *No disrespect should be shown to the flag of the United States of America; the flag should not be dipped to any person or thing. Regimental colors, State flags, and organization or institutional flags are to be dipped as a mark of honor.*

    *(a) The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property.*

Alito’s “denial” is obviously a lie – the notion that a wife of an Associate Justice of the U.S. Supreme Court is unilaterally deciding what flag is flown outside the justice’s home without his input is a blatant lie. It wasn’t up for a few hours – it was up for days. That didn’t happen without Justice Alito’s sanction if not directly by his own hand.

    So the real question is what happens when a sitting justice on the Supreme Court openly lies to the American public about something that goes to the core of the justice’s loyalty to the United States?

    That lie actually undermines Justice Alito and calls his entire jurisprudence into question *more* than his openly flying a symbol of disloyalty to the country that he purports to serve as a justice on its highest court. If Justice Alito lies to the American people about the flag in his own front yard and how it got there, can we really believe he is an honest jurist calling balls and strikes? With a lie like Alito’s hanging out there in the open, does anyone really still believe his denials about leaking the *Dobbs* opinion to Politico? It’s just blatantly obvious now that the man is dishonest and there is no way the Court can endure with a dishonest jurist sitting up there; that tension can never be resolved.

    His colleagues should be publicly calling for his resignation. And beyond that he should be shunned and cast out by them if nothing else. Frankly, I think the Court can do something radical and should: a statement from the other 8 justices saying that the Court asserts it’s prerogative to act unanimously to exclude from its membership any justice who does not command the respect of his colleagues and otherwise brings dishonor on the Court and its decisions, stating also that Justice Alito will not be permitted to participate in conference with the other justices, his opinions on cases will not be solicited or published in the US reports, and that his dissents and concurrences in cases thenceforward shall not be accorded any precedential or persuasive value by any federal court. Let him “appeal” that decision to a higher court and leave it at that.
