

Hi all,
I went to Ibiza on Sunday, 26th May, and came back yesterday. My car had been parked outside my house as usual. However, Thames Water decided to do work while I was away, and my car was fined for parking in a restricted area. There was no advance warning notice before I left.
Do I have grounds to appeal? I have proof of my flights, etc., but legally, isn't the council required to give at least a week's advance warning? There was no warning through the post box either. Luckily, my mum spotted the fine that morning and asked my brother to move my car before it got clamped and towed away.
I am just checking if there is a legal requirement to give advanced warning for at least a week?

Yea that’s open and shut, give them a call.
Don’t mention that they’re supposed to give warning, just say there was no notification before you went away.

Appeal and the fine will likely be removed; you might need to show flight receipts, but that is about it.

Something similar happened to me. If I remember correctly, the fact that there was no sign when you parked the car is irrelevant; you can’t leave a car parked for months and be exempt from any future parking restrictions.
What matters is if the council gave enough notice. Also, not sure what happens if those were emergency works for which not enough notice could be given
Just send them your holiday details and you won’t have to pay. Happened to me twice. No way they would let that go to court

Appeal it and send them proof. There’s always a high chance they reject cause their cunts.
This happened to me three times. Am currently about to appeal. They NEVER give notification.

Did you use a park and ride service? There are reports online about using cars when they were supposed to be parked.
Always appeal. The people handing out the PCNs are doing their job per the letter of what they currently see. They don’t know that you’ve gone on holiday, nor when the signs went up. They also don’t care if signs are misleading. They just know the rules. The council can then judge if the signage was not clear (or didn’t even exist in your case).
Yeah, unless they can prove they have advance notice you’ll not need to pay.
