
Hello! I have been researching a tenant’s rights. I know for unlimited leases, there is usually a three month notice period and for fixed-term leases, you can only break it under exceptional circumstances ([source](https://russianvagabond.com/how-can-you-terminate-a-lease-agreement-in-germany/)). However, I am currently looking for a new apartment in Berlin and I have seen some listings that offer unlimited leases but there’s a two or three year commitment, and then the lease becomes unlimited.
Does anyone know what the rules are during these first two or three years? Do the same rules apply as fixed-term leases? I’m curious what my options are if for whatever reason I need to get out.

Your options are to continue paying for the full duration or hope your landlord allows you to get out before.
If you can already anticipate situations where you would need to move out, don’t sign such a contract. These conditions are legally allowed as long as they aren’t too long (and two/three years is legal).
Contracts are upheld here, and signing something that’s legal on the vague hope of maybe somehow getting out of what you signed isn’t wise.
