I am trying to understand the difference between E13 and E14. With a quick google search I think it still is not very clear.
For example you can see here the [requirements for E14](https://www.jobs-beim-staat.de/tarif/tv-l_e14):

Which is essentially the same in terms of qualifications. I was expecting that for E14 a completed PhD would be needed but apparently not(?). In other sites I found that the difference is the job responsibilities that you have (because the same qualifications are required for both E13 and E14), but still not a conclusive answer.
Now, my latest contract was E13/Stufe 3. I have applied for a job which states “**up to** E14 TVöD”. Who determines if I will actually get E14 for this new job? Is it something standardized based on my qualifications/experience, or is it a matter of negotiation between employer and potential employee?
And if I actually get E14, do I start from E14/Stufe 1^((which is less money than my E13/Stufe 3)), or do I continue from E14/Stufe 3 (since the Stufe has to do only with years of experience and I already have the necessary years for Stufe 3)? Because if I were to start from E14/Stufe 1, [it would be more beneficial for me to simply stay at E13/Stufe 3](https://oeffentlicher-dienst.info/c/t/rechner/tv-l/west?id=tv-l-2021&matrix=12), right?

It depends on how the actual position is rated. A possibility would be for example: The position itself is rated E13 due to the knowledge needed to work in it. E14 would be equivalent on the required knowledge but also include administrative work like in department HR (signing of vacation etc.), regulating system access or generally being the deputy to the head of department.
This is usually determined by the HR department of the place you apply to. Since it’s ÖD they usually have a catalogue of degrees they consider “good enough” for a E14 position and it is possible that they might be the same requirements as for E13. This is a question you can ask during the interview.
Same goes for experience: in principle, HR departments aren’t obliged to recognise your previous experience when determining your group but if your experience is relevant to your new position, they often can do. This is also something you can ask during the interview.

In general, E14 is for positions with more responsibilities than E13, eg as team or project lead. They might only decide to give you those responsibilities after your interview to see if you’d be qualified for them.
*If* your previous Stufen count here (which is not at all given when switching employers) and you are in E14, you’d start in the lowest Stufe that still gives you at last your previous salary. Same with E13, if your experience counts, you’ll start over in month 1 of E13/3, otherwise in month 1 of E13/1.
My understanding is that at least for my university, e14 requires having workers who report directly to you. As others have mentioned that determination is going to vary depending on your hr.
