Ummm, what’s the penalty for that cus I’ve seen CONSIDERABLY worse/more threatening posts out there.
I dont like this at all. Its an awful tweet and the guy is an idiot but imo its not illegal. Considering when day to day online abuse is worse is it only illegal when the target is a hero?
Thats not a law im comfortable with. Its his free speech to say awful things and I will defend his right to say them even though I vehemently disagree with what he said.
Sometimes communications need to be offensive.
This is a daily reminder to never say anything even remotely edgey on the internet, and to regularly wipe your accounts.
It will come back to hurt you if you have.
Though what an excellent opportunity for the daughter to continue her quest for fame by jumping on this.
Every time people say they won’t accept a vaccine mandate, negative tests before entering a large venue or wearing a fucking mask I keep hearing that’s because British people love personal freedoms too much.
Since that’s the case I have no doubt at all that they won’t stand for this (and other things like the protest bill and the Snoopers’ Charter).
I can understand the judgement becuase clearly the guy intended to piss people off when they were enjoying some kind of weird national grief process.
I don’t agree with it though, people need to realise that they don’t have the right to not be pissed off by other people’s ideas.
Yeah can we just have free speech enshrined in law like the US please? Scrap section 127, stop policing speech and let people get on with it. Being offensive shouldn’t be an offence
Just as a note in case anyone doesn’t know, slander, calls to action, actually inciting violence etc don’t come under free speech.
Reading the article it seems like the tweets context was about English soldiers in general rather than a personal attack of Sir Tom. While it’s in bad taste, I’m surprised that it made it to court.
I don’t like to see hate speech laws used to protect Tory heroes.
I feel like hate speech laws should be used to protect everybody from online criticisms or nobody at all.
This is embarrassing. We don’t lock up twats for tweets in this country.
Who gives a fuck? Tom was more of a puppet than Kermit. Walking around a garden, give me a break.
Oh no an awful tweet……
Go do something important like finding and prosecuting real criminals. Time and money wasted.
If I heard someone saying what he did in real life, I’d just assume he had some form of learning difficulties and move on. Why anyone thought it was in the publics best interest to prosecute him I have no idea.
Maybe just ban the guy from twitter for being excessively knob-headed and call it a day.
If he’s not allowed to say it, why are they allowed to repeat it?
If you’re gonna start arresting people for hating British Soldiers, you’re gonna have to arrest half of Northern Ireland.
Scotland have made a habit of prosecuting “offensive” internet activity. I doubt they’re about to stop.
Absolutely horrific the way this man has been puppetered in death. How many people have profited off him? Why are they using the emotions around him to push a bizarre prosecution through? His daughter is using his image as a content farm on Twitter. Let the dude rest in peace
Edit: For the record, it’s a gross tweet, but prosecution worthy? Maybe if there were threat or the person had violent precedence but I’m not convinced from this article
Not that I’m condoning that tweet but…
Police won’t bother with burglary or muggings or assaults, but send a nasty tweet and they will be all over you. It’s a ridiculous.
That is hardly the worst tweet ever, I suspect many more were directed at him that did not get half as much attention. It might not be pleasant to read for his supporters and family but there are plenty of people who felt the national reaction to him was pointless or over the top. It is also not like other public figures do not receive similar messages or worse, with many MPs receiving death threats, to the point it is considered normal. He’s a dick but that is hardly worth arresting him for.
What the fuck.
Why wasn’t this immediately thrown out of court? Since when was it illegal to say non-classified things online?
> Sheriff Cottam told Kelly: “This is a man who had become known as a national hero, who stood for the resilience of the people of a country struggling with a pandemic and the services trying to protect them.
> “His statute and the view of society towards him must be looked at in that light and therefore any comment likewise.
Patriotic music swells in the courtroom. A golden eagle alights on the roof and sheds a single tear.
This country is embarrassing when it comes to freedom of speech. People shouldn’t be arrested for speech unless they’re threatening violence against someone.
Bone-headed tweet. The guy who wrote it is clearly a massive nob. But this should not have been a matter for the justice system, at all. Causing offence shouldn’t be illegal.
Fuck Captain Tom why is he venerated as some untouchable holy figure? He was just some old guy used to drum up saccharine patriotic sentiment. That judge is a scum bag.
Anytime the government steps in and decides what we’re permitted to say or think, we risk a slow slide down a slippery slope. Everyone has the right to be offended at whatever they choose, but should we leave it to the powers-that-be to make subjective determinations of what they believe we should be legally offended by?
This is embarrassing and so unnecessary. Same with the Count Dankula thing, fined for a still available video of a dog doing a Nazi salute. OK so it was offensive and there was a hint of encouraging hatred in there but what does it actually achieve? It wasn’t *to* him or something that could be perceived as a threat. The quote has gone from some obscure tweet from a nobody to in print all over the news, so bra-fucking-vo.
Scotland really seem to have went off the far end for punishing stuff like this.
The tweet so grossly offensive that is was still ok to print in an article. The guy might be a piece of shit but this is a slippery, slippery slope. Threatening to put him in the cell for shaking his head.
I don’t agree with what the guy said but worse has been said to people and worse gets said to kids growing up facing online bullying and very little so done about that. Even with in schools it’s often the bullied one that faces the most consequences.
Honestly I find what Boris did a lot more offensive to Captain Tom then this….
This particular case, and the 2 cases before it were all in Scotland. Whilst we share the same law on the criminality of being offensive there have been no prosecutions any where else in the UK as far as I am aware. The only other 2 cases were the guy who put the YouTube video of his pug doing nazi salutes and a teenager who posted an image on her Facebook page to her friends only that quoted lyrics from a rap song verbatim after her friend died. The last one got me. Posting lyrics from a song that was being legally distributed and played on the radio is bonkers.
Lefties gradually realizing the same laws which they applauded when used to censor “chuds” on twitter will also be used to put them in jail for joking about war veterans dying. If a Scot got jailed for making a Thatcher death joke in the same manner this sub would literally implode
Can we sentence people to stop being a dick on the internet?
We’re free to say what we like. Provided we say the right things.
You lot were quite jovial when people were prosecuted for alleged racist tweets and criticising Islam. “Freedom of speech not freedom of consequences” I believe you jeered. Well, you reap what you sow.
I hate what he said but I wish our freedom of speech was protected like the US. Everyone has the right to be offended but we shouldn’t control what people say.
The quotes are hilarious in this article.
“Another person who saw the tweet, Luzier Jeffery, Kelly’s neighbour at the time, said she was “shocked” when she saw the message.”
Wow.
To think he could have walked somewhere interesting instead of his garden if he was a cabinet minister.
The guy is obviously a twerp but this is an appalling verdict. His tweet was distasteful but certainly not even remotely worthy of any police involvement.
Perhaps the powers that be could stop prosecuting people for some utterly trivial words (no matter how offensive) and start going after real criminals. If your house gets burgled or your bike gets nicked good luck getting the police to attend but say a few offensive words and they’re all over it.
Freedom of speech is very much under threat and this sets a horrible precedent.
What the fuck is this world coming to. Tom can go on holiday abroad during a global pandemic and he faces less justice for his immoral actions than this dude does.
Walking around your pissing garden doesn’t make you a good person.
Funny this comes after that report which shows police only solve about 5% of crimes. They really do have their priorities straight huh
It was in bad taste but really, we are prosecuting people for writing something distasteful? This is very wrong.
There is a reason even the UN thinks Scotlands hate laws have gone way way too far.
Figured it’d be Scotland. YouTube’s Count Dankula went to court because he taught his girlfriend’s pug to do a Nazi Salute on command.
