As he reminded, on the basis of this provision, the Czech Republic sued Poland to the CJEU for the operation of the mine in Turów.
Article 259 TFEU allows any Member State to bring an action before the Court of Justice of the EU if another EU member is found to have breached one of its Treaty obligations.
– It is in Germany that politicians have a decisive role in the process of nominating judges to the equivalent of the Supreme Court. I will submit a request to the Council of Ministers to consider taking up the legal procedure of suing Germany before the CJEU for violating the EU treaties by politicizing the judiciary – announced the head of the Ministry of Interior.
– If the CJEU states that the participation of politicians in the procedure for the election of judicial authorities in Poland raises doubts related to the independence of future judges, then let us ask what impact this participation has on the independence of future judges in Germany. We have introduced democratic mechanisms in the selection of judges. And this fact has become the main accusation directed against the authorities of the Polish state – said Ziobro.
There should be no ‘equal and more equal’ in the European Union, this applies as much to citizens as to states. If it turned out that the CJEU applies different legal norms and standards to one country and others to another, this would be a very important fact.
