Supreme Court: “LOL no”
Roberts acknowledged in his decision that “distinguishing the President’s official acts from their unofficial ones can be difficult” and that it “raises multiple unprecedented and momentous questions about the powers of the President”. He made a point of not expanding any further and, in sending it to the lower courts, made it known that Presidential acts will need to be determined to be official or unofficial on a case by case basis going forward.
In other words, that’s the literal extent of the guidance the lower courts will get from SCOTUS. The lack of any further explanation was on purpose.

SCOTUS will jump the shark when they have to explain why paying off hookers is an official act.
What’s to explain? Several justices are bought and paid for. They have probably destroyed democracy and a couple of them are proud of it and hope to do more damage. They’ll receive truckloads more cash and personal protection for their efforts. We’re an oligarchy like the Russians now. Soon it will be time to start arresting anyone that dissents.

The president has presumptive innocence and legal immunity for official acts. Courts can’t question the motivation, intent, or communications of the president to determine if an act was official. Alleged illegality of an act also can’t be considered by the court to determine if an act is official or not. Courts explicitly cannot introduce any danger of intrusion to the authority of the office.
Good luck proving any act of the president is not official.

Lower courts will make the determination of guilt, SCOTUS overturns the ruling on appeal based on vague earlier guidance provided to lower courts. SCOTUS becomes the arbiter of presidential power depending on who they want in power

What breaks my brain is that Roberts was appointed by George Bush. The current court might have been brewing in the basement of some diehard Confederate in Texas, but I really doubt it had all the ingredients, let alone come to a boil. No, this is Roberts’ court. This is his legacy: enabling Trump. I really don’t think that’s something Bush would have wanted. Cheney, maybe, but not Bush. Not sure what happened along the way, and it gives me a headache to think about it.
The fact that they did this because they know the other party won’t take advantage of it is infuriating. If the democrats had the morals of the republicans, military action ordered by the president against the republican justices and trump would be considered legal by their own standards.

This is key. Since all of those decisions will eventually come to the SCOTUS, it means this is a huge power grab for the SCOTUS as they’ve placed themselves in the position of incredible power over the president.
Unless the dems run the table big in the house senate and hold the presidency. Then in turn expand the court and impeach two of the justices and frankly I think Thomas and Alito would step down but you still would have to expand the court.
If “explaining” is not in the Constitution as something SCOTUS needs to do – it ain’t going to happen.
