  4. I appreciate him for going through the motions but its too late. Cannon tanked the case. Even if the appeals court picked up the case tomorrow, there wouldnt be time to go through the trial before november. Heck, his conviction in NY still hasnt even been sentenced yet.

  5. If that’s her opinion, why didn’t she make that ruling a long time ago instead of going through god knows how many hearings and delays in between?

  8. Good. My only fear is that they send it back to her. She already dismissed it, she’s made up her mind. Would be a major conflict of interest in my eyes and I hope others

    Special prosecutors have been used since 1875. Congress has done very little to regulate their use, though SCOTUS implicitly acknowledged and allowed it in *Morrison v. Olson* (where they called special prosecutors “inferior officers” and not “principal officers”, unlike Thomas and Cannon). Thomas, and by extension Cannon, just hand-wave away that argument and say that decision is now irrelevant.

  13. This is Cannon’s 3rd strike with the 11th circuit. They’ll remove her but it will still eventually end up with the Supreme Court.

  14. Cannon followed her handlers suggestions (see Thomas’s concurrent statement in the immunity case where he, in my opinion, was speaking directly to Cannon). Every ruling she has made was done in such an untimely fashion as to delay, delay, and delay again the movement forward on this case. She had net even set a date for the trial to begin.

    AS far as the judiciary goes Cannon is a waste of skin and should never have been appointed to the bench. She is an embarrassment to the rule of law. I would expect that other judges find her embarrassing.

  16. Geez there are pics, surveillance footage, and got caught with more once the FBI showed up, after lying about it several times. If any other person got caught with this kind of evidence, this would be the gift that keeps on giving for a prosecutor but yea, case is no good. 🙄

    The justification Cannon gave for dismissing the case, was the exact opposite of “weaponization of the DOJ.” It was that the special counsel wasn’t sufficiently controlled by the Executive branch.

  18. The 11th made a scathing ruling last time and seriously called her out for her lack of understanding of the law.

    This time, it will also be on record, unanimous, and they will remove her from the case.

  21. Props to Smith for fighting to the end, but this case isn’t happening until after the election.

  22. To clarify, he filed a notice of appeal not an actual appeal. He still needs to have the clerk of court prepare a record of the motions and exhibits and index it, then he needs to read the record and draft the appeal, citing to the page and line numbers of the transcript and cite statutes/cases/law review articles/secondary source research. This will probably take 45-75 days to prepare and file. And then another month or so for oral arguments in Atlanta.

  24. I don’t understand how the choice of prosecutor could eliminate criminal charges. How does the choice of prosecutor undo the crime?
