I’m struggling to see the relevance given that this was a nonconsensual sex crime regardless of the victim’s orientation? Is the implication it would have been a lesser crime if he was gay or bi, or a woman, and seeking an encounter? This just feels like an inversion of “the victim was asking for it” tactics, especially given that one of the perpetrators had spiked women’s drinks in the past. Absolutely fucked court system.
