In the terror trial before the Munich Higher Regional Court, IS returnee Jennifer W. was sentenced to ten years imprisonment. The court found her guilty of, among other things, membership in a terrorist organisation abroad, aiding and abetting attempted murder and attempted war crimes – as well as crimes against humanity in the case of an enslaved and killed child.
The Federal Prosecutor’s Office had accused the 30-year-old from Lohne in Lower Saxony of standing idly by in Iraq while her then husband chained a five-year-old Yazidi girl in a courtyard and left her to die of thirst. She was originally charged with murder and war crimes, among other things.
The child had been “defenceless and helplessly exposed to the situation”, said presiding judge Joachim Baier. The accused had “had to reckon from the beginning that the child, tied up in the heat of the sun, was in danger of dying”. However, she had “done nothing” to help the girl – although this had been “possible and reasonable” for her. The court was also convinced that Jennifer W. later threatened to shoot the girl’s mother when she was crying for her child if she did not stop.
**Prosecution demanded life imprisonment**
The federal prosecution had demanded a life sentence, the defence, on the other hand, a maximum two-year sentence for membership of the terrorist organisation “Islamic State” (IS).
Jennifer W. herself raised accusations against the judiciary. “The much quoted sentence ‘When in doubt, give the accused the benefit of the doubt’ did not apply in my case,” she said in her closing statement in court. She was apparently to be made an example of for all the wrongs that had happened under the terrorist organisation.
According to her own statement, she had travelled to Iraq in 2014 to marry an IS fighter there out of ideological conviction. In the summer of 2015, according to the indictment, she watched a girl exposed to the blazing sun in Fallujah, unprotected and without water. As punishment for wetting the bed, her husband allegedly tied the five-year-old to a window grille. A torturous ordeal that, according to the indictment, led to her death. The charge in the indictment was murder by omission.
The accused finally also apologised in her last word in court and referred to her ex-husband, who is on trial in Frankfurt am Main. However, she had been powerless in the face of the man’s actions and could not simply untie the girl.
The defendant had been aware of the anti-human aims and deeds of the IS when she left for Iraq to join the organisation, the Higher Regional Court emphasised in the reasons for the judgement. Jennifer W. and her husband had exploited the mother of the deceased girl as a house slave, Judge Baier explained. The woman had been beaten daily. W. had often incited her husband to do so. With her IS membership, she had supported the “destruction of the Yazidi religion” and the “enslavement of the Yazidi people”.
According to the Yazda Yazidi organisation, the Munich trial was the first in the world to accuse IS members of crimes against the Yazidi religious minority.
Yazidi woman and Nobel Peace Prize laureate Nadia Murad called the trial, which started in April 2019, a great moment and an important trial for all Yazidi survivors. “Every survivor I have spoken to is waiting for one and the same thing: for the perpetrators to be prosecuted and brought to justice for their acts against the Yazidis, especially against women and children.”
So why did she get only 10 years? I mean the prosecution demanded life, according to the article, so what was the deal here?

This case really covers one of the most revolting crimes to come out of the whole ISIS abomination.
They’ve killed more people, carried out all kinds of tortures and public executions, but this case about enslaving a 5-year old girl and letting her die to the elements has stuck with me ever since I first read it.
There’s just something so profoundly evil about the entire case. You imagine that any human, on some primal level, would see a 5-year old in pain and be moved to help them. To instead willfully bringing about their death, it’s hard to believe.
And yet these lunatics did. And when they got bored of playing caliphate, they took their privileged passport and booked it back to Europe.
There are still Yazidi women that languish in camps and face a lifetime of poverty and alienation, whilst the freaks that caused it get to complain they have to face any accountability at all.
Someone should do a meta analysis of jailing threads. And see how many people find sentences low. I know it’s a heinous crime but saying that 10 years is short.. man..
Here in Kosovo we sentence those who have joined Isìs to 15 years od jail only for that and also for any crime thay did there +25 more!
Since they put a bad name on us by saying we are muslim country( which we are not) and we dont follow eny islam rules only ” Eid Mubarak” we like to celebrate!
And for that we are taking anyone to jail for everything related to this kind of terrorisem, even if they talked through internet to join they will face 5 years in jail!

As an American the way our prison sentences work is someone who gets 10 years will typically get out in 7 but as I understand it in most European counties prisoners typically serve every bit of their sentence and murderers are usually sentenced to more time once their original sentence is complete so is that the case here ? She can’t possibly get out in 10 years right ?
