I thought the IRA specifically defined greenhouse gases, and co2 by name, as pollutants covered by the clean air act.
My memory is a bit fuzzy on the topic, but didn’t a prior version of our Supreme Court already rule that CO2 was a pollutant under the Clean Air Act?
I vaguely recall this coming up under the Obama administrations power plant emissions fight. The rules were shot down because their structure didn’t align with the Clean Air act, but it was acknowledged that the Clean Air act covered CO2.
Am I misremembering this?
The oil companies definitely knew.
There’s no getting around the problem that the current Supreme Court would never allow facts to interfere with its agenda.
They all knew. They just figured they’d be dead by then and the rest of us could blodger right off.
