“In her opinion, Judge Chutkan emphasized that at the motion to dismiss stage, the court must assume the truth of the indictment’s allegations. She pointed out that Trump’s characterization of the indictment as criminalizing his public disputes over the election outcome was a misrepresentation. The indictment, according to Judge Chutkan, charges Trump with knowingly making false statements to further criminal conspiracies and obstruct the election certification proceedings.”

This trial is going to be exhausting. He is going to claim everything was done under the power of his office.

He was doing a whole lot more than disputing.
That weird, tired old felon will be in court for the rest of his life.
Just a few weeks ago Trump was on such a glide path to victory, everything was coming up roses for him. Immunity case win, document case tossed by his pet judge, polling well against Biden, RNC that conservatives were really hyped about, surviving the assassination attempt, etc.
How fast things can change.
I’m no lawyer, so perhaps one can help me out. My understanding is that you are innocent until proven guilty, but I read this from the judge: “at the outset of the trial process, the court must assume the allegations against Trump are truthful”.
Isn’t the burden of proof on the prosecution, NOT the defendant?
In case, like me, you found yourself asking “which election subversion trial is this?”, the answer is it’s the federal one not the Georgia one.
Per Politico:
In the two months between Election Day in 2020 and Jan. 6, 2021, Trump mounted a wide-ranging campaign to subvert Joe Biden’s victory in the presidential election. Trump and his advisers spread false information about voter fraud, urged Republican state officials to undermine the results in states that Biden won, assembled false slates of electors and pressured Mike Pence, the vice president, to unilaterally toss out the legitimate results.
Trump has been charged with four crimes in the federal election case.
– Two relate to the disruption of Congress’ certification of the electoral vote on Jan. 6.
– One alleges a scheme to defraud the United States through a sustained effort to impede the collection, counting and certification of votes in the 2020 election.
– And the fourth charge accuses Trump of a conspiracy to deprive citizens of a right secured under federal law — specifically, the right to vote and to have one’s vote counted.
If this case goes to trial before the election, even if they’re no where near coming to a verdict, a presidential candidate currently being prosecuted in court all the way up to the election speaks volumes.
