Hello, possibly this has been answered before but I can’t find it. Basically, I was doing a PhD trial period in Munich with a skilled workers visa (called type D visa in the UK as I am a national there) which expires in March. I wasn’t enjoying my trial so I won’t be continuing my contract but I want to stay in Munich and look for work.

I haven’t been here long enough to speak German but have work experience and a masters degree in computer science. I’ve looked and can apply through the [UK diplo](https://uk.diplo.de/uk-en/-/2449442) website, but apparently they will not help me until my current visa expires.

As I don’t want to get deported in March I need to apply for a [job seekers visa](https://www.germany-visa.org/job-seeker-visa/) and hopefully during the processing time I can stay in Munich. I have accommodation and fulfill the criteria for the job seekers visa, but I can’t find in on the [Munich foreign office](https://stadt.muenchen.de/buergerservice/ausland-migration.html) website.

I went to the Munich foreign office and they recommended that I apply for a [work after graduation](https://stadt.muenchen.de/service/info/hauptabteilung-ii-buergerangelegenheiten-auslaenderangelegenheiten/10260824/) visa, but my masters is from the UK so I think they misunderstood my situation.

To add to the confusion, the Berlin foreign office does have a [skilled work visa](https://service.berlin.de/dienstleistung/324661/en/) application process, but as a resident in Bayern I am unsure if I can apply here or not.

My questions are :
– Is there a visa for my situation that can be applied for in Munich (any links to this would be helpful)
– If no to the first question, could I apply through the Berlin applications portal as my residence is in Bayern
– If I am in processing of this applying for this new visa, what documents can I show to stop being kicked out

Any links, experiences, help, info people can provide would be invaluable, all my personal belongings are here and I need to know if there is something I can do or if I will be separated from them and have to go through the immigration process from the UK again.

Thanks so much !

  1. You can apply for any type of permit anywhere. Just because it’s not on their website doesn’t mean you can’t apply for it. You must apply where you live.

yes, the 6-months jobseeker visa: https://www.make-it-in-germany.com/en/visa-residence/types/jobseekers

you can not apply for the 18-months jobseeker after graduation visa since it only applies if you have graduated at a German university.

You can only apply where you live (= currently only in Munich, not in Berlin and not at the German embassy in the UK unless you move there).

You can apply at any Ausländerbehörde for any visa no matter if they have a website or what is listed there.

    Section 81 Residence Act

    (4) “If a foreigner applies for an extension of his or her residence title or for a different residence title before his or her current residence title expires, the current residence title is deemed to remain in force from the time it expires until the time of the decision by the foreigners authority.”

    (5) “The foreigner is to be issued with a certificate confirming the effect of the application (provisional residence document).”

The German name for the provisional residence document is Fiktionsbescheinigung.
