Need a clarification about sick leave policy and if anybody had similar experience.

My contract clearly states that a sick leave must be submitted the day that follows the second working day of absence.

The company has now a new policy that the employer must submit a sick leave note from doctor from the first day, effecting immediately.

The question is, is this allowed without a contact change?

Am I misinterpreting the contact paragraph? See photo

    2. “ohne Aufforderung spätestens an dem Arbeitstag , der auf den zweiten Tag der Arbeitsunfähigkeit erfolgt” – “without request at the latest on the working day following the second day of incapacity for work”

    Your employer now requests immediately. This is effective, since it’s already in your contract.

  2. The Paragraph says in the beginning “unverzüglich” which translates immediate, and only when nothing was asked for, latest after the second day of beeing sick.

  3. The first sentence says distinguishes two cases. If the empolyer requests it, the sick leave must be submitted without undue delay. Without a request, the sick leave must be submitted the day that follows the second working day of absence.

    The employer now generally requests the sick leave notice, kind of a standing order.
