Couple of weeks ago I posted here explaining that my girlfriend received a fine saying she passed a stop sign in Mons while she was at Louvajn-la-Nevis that day.
She contacted the parking company in LLN that she parked her car at, and they send an entrance and exist proof with the time stamp. We provided that proof on the website for objection to the fine and couple of days ago we received this letter. https://imgur.com/a/7qewM8L

This is some top level bullshit and injustice for something we haven’t done and yet spent almost 30 euros just to prove it wasn’t her car that day. At this point I’m ready to not pay the fine and instead get a lawyer. On this letter they don’t even say you can object back to this decision and provide more proof. They just provide a helpdesk number that we will contact on Tuesday. But they really messed up our weekend with this shit. It just makes me question how broken is this goddamn forsaken system.

I appreciate further suggestions.

  1. Did the entry and exit proof include a picture of car/license plate?

  2. Ask them for proof it was ur car & get in touch with a lawyer asap.

  3. Imo, the whole ‘proces verbaal’ stuff in traffic violations is so 1970’s. Upgrade to 21th century please and require video proof from the police…

  4. The sole card readout will probally not be accepted as proof, a PV has a juris tantum (greater value of proof) than what you provided. As long as it was send within 14 days of it being made.

    I understand you: but this is what will happen.

    You will find a lawyer who wil bill you at least 1000-2000 euro’s to appear in court.

    He wil present the proof, the judge wil ask if this is al. Because the jurist tantum the Procureur wil just say that he is in the right.

    You will get a fine, x8 +cost consisting of about 200 euro for de huissir, some forfaits for stuff like het slachtofferfonds e.d.

    You will be payin 20-30 times the fine you have now. Yes i am a lawyer.

    Pay the fine or go to court. I’ve never seen a commune or the cops go back on their decision (People under oath are always right). They don’t care because they know that no one will fight a fine of less than 500€.
