I have been living in Germany for more than 5 years, first as a student for 3 years then as a full time employee since 1st Feb 2023. I was eligible for a blue card since 1st feb 2023, however the blue card was issued to me on 11th April.

My company is offering me a mutual termination in the end of January which seems like an interesting option.

I have seen that if I am working on a blue card for more than 2 years, I will be given 6 months instead of 3 (source – https://abfindungshero.de/en/blue-card-job-loss/). I dont know the original/legal source of this information.

  1. So does the duration blue card in my case start from 1st Feb or 11th April?

  2. Can someone please confirm that I will get 6 months to search for a job and also if I wont be eligible for unemployment benefits for the first 3 months.

  1. 1. It starts from whatever date is printed on your blue card. Usually the issuance date or earliest the approval date, not the application date.

    2a. There is afaik no official rule on how long you will get for job search. Your blue card validity legally ends the day you finish at your job. Any extension is at the discretion of your local ABH. Usually, it is first given for 3 months. If you can show you can sustain yourself and are likely to find a new job, it may be extended. None of this is a right, just at discretion.

    2b. You will not get unemployment benefit for 3 months if you resign. Signing an agreement counts as resignation.
