The man accused of a shooting at a pro-Israel rally in Newton will be back in court in the new year.Scott Hayes faced a judge for only a few minutes in Newton District Court on Tuesday. His trial date could be set during his next hearing.The 47-year-old Framingham man was charged with assault and battery with a dangerous weapon, as well as violation of a constitutional right causing injury.These charges stem from an incident in September, where Hayes was accused of shooting 31-year-old Caleb Gannon of Newton, after Gannon ran across the street and tackled Hayes to the ground during a pro-Israel rally.Officers from the Newton Police Department responded to the altercation near Washington and Harvard streets in the Newtonville neighborhood, where a small group of protestors were gathered at the street corner, showing support for Israel in the war in Gaza.Witnesses said the altercation began after Gannon walked by the protestors on the other side of the street, shouting comments at them, resulting in a verbal exchange.Video showed Gannon running across the street and tackling Hayes to the ground. An altercation followed, during which Gannon was shot by Hayes, officials said.Gannon was hit in the abdomen and received aid from Hayes and others at the scene. He was taken to the hospital and was able to recover from his injuries.Hayes, a contractor with National Grid, was released on $5,000 bail after his arraignment at Newton District Court.Both supporters and opponents of Hayes stood outside his court hearing on Tuesday, carrying signs for and against him.
