Mexico calls on ICJ to establish clear guidelines for States’ climate change obligations

Mexico participated today in hearings held by the International Court of Justice (ICJ) on the request for an advisory opinion on States’ obligations related to climate change.
Mexico advocated for strengthening the international legal framework addressing the climate emergency, with a focus on human rights and a gender perspective.
The Mexican delegation emphasized the ICJ’s crucial role in clarifying States’ obligations regarding climate change and bringing greater coherence to the applicable legal framework. It argued for the need to repair damages, with a focus on shared but differentiated responsibilities, and highlighted the interconnection between climate change and international peace and security.
Mexico stressed the importance of interpreting climate change regulations in conjunction with broader principles of international law, including the precautionary principle.
The delegation further underscored the need for countries to take responsibility for preventing environmental damage, even under conditions of scientific uncertainty, and advocated for ensuring people’s right to a healthy and equitable environment for future generations.
Mexico noted the importance of holding States accountable when they fail to meet their obligations, emphasizing the need to ensure fair reparation measures, such as restitution and compensation, supported by scientific tools for measuring the environmental impact.
The Mexican delegation reiterated its firm commitment to climate action, promoting legal, financial, and international cooperation frameworks. It emphasized the need for a unified global response based on principles of equity, justice, and sustainability.
The request for an advisory opinion was submitted to the ICJ by the United Nations General Assembly through resolution 77/276 in March 2023, with Mexico as a co-sponsor.
Mexico’s position was presented by Foreign Ministry Legal Advisor Pablo Arrocha; Carmen Moreno, Mexico’s Ambassador to the Netherlands; Alfonso Ascencio, Deputy Chief of Mission at the embassy; and Patricia Pérez, Legal Advisor at the embassy.
Mexico’s participation at these hearings reaffirms the government’s determination to lead efforts against climate change, and to strengthen international norms to protect the environment and ensure a secure and sustainable future for generations to come.
