Can anyone help me. I’m very overwhelmed my husband was pushing my two kids in their strollers and was hit by a car today at a crosswalk. The police have come to the hospital and told me they believe the driver is at fault.

I need to return this form to the police tomorrow but I am not sure which box to check. I mainly think the driver should be responsible for medical costs.

My husband has a brain bleed and skull fracture. My 1 year old has injury to her liver. We are here overnight at the hospital. We are here on holiday from the United States so we have no medical insurance here.

  1. You absolutely need to get in touch with a lawyer ASAP. I have no connections to the region where you are currently located. Hopefully someone else can point you towards someone you may contact. Meanwhile I hope the best for you guys and look online for possible legal help around you or go ask the police where you could go get some, they might be able to help.

  2. Hospital bill won’t be crazy – it’s far from US prices. But you might still want to chose option B and at least claim factual expenses. Every Swiss driver must have an insurance which would cover parts of it. ER and hospital stay is NOT a financial disaster outside of US 🙂 Just collect your actual expenses, which will include lost tickets, hotels, and of course the medical aspects. Unfortunately the bill will come later.

    In general, don’t worry about financial side – stay safe and get healthy. This is most important.

  3. IMO You should check option B. You need to get a lawyer, like everyone else mentioned. Call the US Embassy and ask for a referral or other help. Do you have travel insurance? If so, call them, too. But absolutely do *NOT* waive your rights to a criminal complaint or compensation. He needs to pay for your bills here.

  4. Sorry to hear this. Hope all your family members get well soon. Yes, get a lawyer as soon as possible. Do you know if the perpetrator is identified? This would move things faster in my opinion. Also, can you share in which part of the city this happened? Just to be cautious around that area in case it us a place with poor lighting, etc.

    2. You do not need to give the form to the police tomorrow. Part 1 of the explanation section of the form says you have three months.

    So you can focus on your family now. As others have said you should definitely talk to a lawyer, but you don’t have to panic that you need to do this within the next day.

    You should only return the form when you’ve had the opportunity to talk this through with a lawyer.
