    Supreme Court Justice Samuel Alito spoke with Donald Trump one day before the president-elect’s lawyers filed a petition asking the court to halt the Republican’s upcoming hush money sentencing.

    Newsweek has contacted the Trump transition team and the Supreme Court for comment via email.

  11. Engaging in *ex parte* communication with a judge involved in your pending case is generally a huge problem.

    On the other hand this requires oversight on the court itself. Seeing as the Supremes are making up their own rules, such oversight is highly unlikely.

  13. The SCOTUS is in its own little world where they don’t even acknowledge the perception that they’re corrupt and politicized. This happened hours before Trump urged SCOTUS to intervene in the hush money sentencing.

    From Alito:
    “We did not discuss the emergency application he filed today, and indeed, I was not even aware at the time of our conversation that such an application would be filed,” according to Alito. “We also did not discuss any other matter that is pending or might in the future come before the Supreme Court or any past Supreme Court decisions involving the President-elect.”

    If that’s so then they should release the transcript of the call. Sounds like he’s got nothing to hide so why not dispel everyone’s perception that SCOTUS are a bunch of right wing political hacks without a shred of integrity left in their entire bodies.

  22. The whole issue is these conversations shouldn’t even be happening in the first place. Absolutely would not happen to a normal middle/low class citizen where if they were found guilty of crimes would be able to call the judge and have a conversation.

    The whole supreme court needs to go, I am a 39m and I know I’ll never fully trust this “inferior court” ever again.

  33. It is insane to think that a non-political body is communicating directly with someone whose cases will come before the court. This is torches and pitchforks type stuff, naked corruption.

  34. There exists in a democracy a certain degree of “willingness,” on the part of officials, bureaucrats, candidates and, even, citizens (plus others) to play by the rules.

    You can mandate behaviors — and we do, and we must — but the more you mandate the less “democratic,” the system becomes (which is at the heart of conservative complaints).

    When a player like Trump enters the fray — someone who refuses to play by the rules and whose violation of the rules seeks to serve anti-democratic and corrupt behaviors — the system breaks down because it is not designed to exclude such a player. It depends on other players and, most importantly voters, to decline to “play along.”

    And, playing along (as so many MAGAts are doing today) while disrespectful of the rules is not automatically or, in some cases even practically, a violation of the rules or laws.

    Democracy and self-representation exists and operates in a grey area that expects, but has a hard time enforcing, fair play and honor.

    Sure, if you break a rule or a law you can be punished, but if you decide to play an entirely different game, the system can be befuddled into submission.

    The worst thing Trump has done is to expose that weakness in democracy…if you have no honor, no willingness to be contained by rules — never mind the laws — and you refuse to be “defeating, by either you opponents or the system itself, , democracy can really turn out to be defenseless. This is because to defend democracy against such an out of control player, almost by necessity, requires becoming less democratic.

    It’s a damn hard Catch 22 to defeat.

    And when others, either out of weakness or corruption, “play along,” with the out-of-control player the democratic systems
    start to break down in ways that accelerate with each capitulation.

    Having been rejected by the natural flow towards “liberalism,” (call it democratic entropy and societal ambiguity) Conservatives have given up adhering to self-enforced democratic rules and behaviors and with each day they hasten democracy’s demise in America. They think they’re defending democracy by blindly they are destroying it by ignoring it (and its fundamental dependence on players playing by the rules).
