My rental agreement has these statements about kündigung and it ends at august. I need to move in april to move to another city. Can I still send kündigung to my landlord and leave after 3 months? If I can’t what is the consequences I am really worried. 🙁

  1. Consequences? You have to pay until August.

    Fixed-term contracts usually can’t be canceled without a reason.

    You could sublease (with the landlord’s approval!) the apartment for the remainder of your lease.

  2. As far as I know, it’s legal to not allow premature cancelation of the lease, if it’s a fixed term lease.

    Worst case, you might need to keep paying until August.

  3. No, you are on the hook for rent ’til August I’m afraid. You could pursue it legally but in general you have to leave the country to have extraordinary grounds for termination.

    Moving to another city for job reasons is entitled to extraordinary termination. You just need to find another tenant or else you need to pay rent till august.

  5. Well, what’s the reasoning for the fixed-term lease? Generally, you need a reason to be allowed to not make the lease unlimited.

    If there is a valid reason, well, you signed the contract, you have to follow the contract. Disallowing ordinary terminations is legal for fixed-term leases.
