Today, the Court of Justice has delivered its judgment in Engie Romania (C-205/23) concerning a preliminary ruling request involving Engie România SA and the Romanian National Energy Regulatory Authority (ANRE).

The referring court asked the Court of Justice to clarify two key legal questions. The first concerned whether ANRE had the authority to impose a fixed price on Engie after finding that it had violated transparency obligations under the EU Gas Directive (Directive 2009/73/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC). The second issue revolved around whether Engie could be subjected to two separate penaltie
