Mr Justice Martin Nolan agreed that Jamie Smith, a fitness instructor from Dublin, was not likely to re-offend and heard he had agreed to drive a van as he was in a particularly difficult financial situation and did not have had any idea of the amount of drugs involved.

Same judge gave a suspended sentence to someone with 1800 images of child porn this week.
Irish people are *constantly* demanding tougher sentences and more law and order policies.
Don’t be surprised when what you asked for leads to unjust outcomes.
To be fair cannabis is way worse that pedophilia
Suspended sentences for all the people with images of children.
Full jail sentence for something daft.
Classic judge Martin Nolan.
When will this man be investigated?!
There is a channel 4 documentary about crystal meth in Norwich. A lad got 10 years for briefly having a drug shipment in his home. They didn’t find drugs in his home but a video showed that the drugs had been there. They come down very hard on drugs in most countries.
Criminals in Ireland have taken to carrying hard drives full of CP with them to avoid jail
Wont be long till Nolan’s sentencing paedos to having a pint with him
Another man was sentenced yesterday to 6 years for a hit and run, which left a young man dead. He left the car on top of his body and fled the scene. His 6 year sentence is running concurrently to his 8 year sentence, meaning he won’t serve an hour for taking someone’s life. He got 8 years for discharging an automatic weapon at a house in which children were playing.
I can’t understand how driving a van full of cannabis is in the same league as killing someone and trying to kill others.
Whatever your views on cannabis are, it does not deserve the same sentence as rape, serious sexual assault, or manslaughter.
Ah yea, Martin Nolan strikes again.
He has clear patterns
If you’re a pedo, rapist, violent assaulter, or an abuser Martin Nolan will do everything in his legal powers to go light on you. He can’t let you away Scott free, but he’ll go as close to it as is permissible within the constraints of the system.
He hates drugs. He’ll throw the book at anyone for drugs offenses, again, within the limits of his position and what’s permissible within the constraints of the system.
Insane that when you see a headline like this the name Nolan pops into your head immediately.
Our embarrassing laws on cannabis strike again. The whole situation surrounding cannabis here is so backwards, its continuing illegality is getting increasingly bizarre.
Murder? Rape? Suspended sentences.
NON-VIOLENT SMUGGLING??? HAVE FUN SPENDING THE REST OF YOUR LIFE IN THE SLAMMER!
Half a tonne of cannabis is a fair amount of gear to be shifting all the same..
I get that the fact that it’s cannabis shouldn’t matter to the sentence (compared to say Heroin/cocaine). In the laws eyes, wrongly or rightly, illegal drugs are illegal drugs. Cannabis shouldn’t be illegal , but that’s the way the law is.
However, even it *was* coke/ heroin, what is the actual point of such a heavy sentence? He’s clearly not a drug king pin.
What’s wrong with a 2 year sentence with a portion suspended due to his lack of priors? This would still presumably serve all the purposes of sending someone to prison
1. Deterrence – from what I understand length of sentence doesn’t deter people that much beyond a point. A maximum 10 year sentence clearly didn’t deter the guy in this case. He still took the risk that he took. He took the risk cause he just assumed he wouldn’t get caught. Like, honestly, any normal person who isn’t in and out of prison, are you really going to chance transporting drugs because the sentence is 2 years rather than 6 or 10?
2. Rehabilitation – the guy will clearly never do this again lest he get another 2 year sentence
3. Protection – it doesn’t sound like anyone needs protection from this guy
4. Retribution – Is there any need for this? Or does this serve any sort of retribution?
I can’t get my head around this sort of thing. I don’t think it even needs to be compared against sentencing for Paedophilia or violent crimes to look absolutely daft and pointless.
But if you do look at violent criminals – putting them in prison *does* serve all 4 of the above purposes.
Can we just please understand that if we regulate it will be better for society as a whole! We know why they don’t want to decriminalize it at this stage it’s easy money for the courts and poor box and easy stats for the garda, Whi by the way should have had zeeo bussiness innthe citizens assembly, but we would all be better off Its not going to get anywhere with this government only thing will happen is for medical use and they will be jobs for the private sector for there buddy’s if it ever does happen like the UK model at the moment which isn’t really worth it. Rapist and pedophiles have it easier should have asked the judge to treat him as one.
It feels like Irish society only punishes crime if the perpetrator makes any money off it.
If there are any real victims like women or children they always skate on a suspended sentence.
It’s a fucking disgrace how untouchable judges are in this country. Remember the crash? Only public servants not to take any pay cuts. I seem to recall them just saying no ffs
The only reason the story is getting attention is because of controversy regarding the judge involved.
Nolan has effectively given slaps on the rest through suspended sentences for offences related to child abuse in the past but he is quite content to shift this guy to prison for a lengthy custodial sentence.
Then again the imbecile was the architect of his own misfortune by agreeing to be a sort of drug mule for a huge quantity of drugs.
He fucked around and found out.
>At the sentencing hearing in Dublin this week, Judge Nolan noted Smith’s immediate admittance of wrongdoing, his cooperation with gardaí and his guilty plea. He described Smith as “likeable” and reduced his sentence from the mandatory ten years.
How do non mandatory mandatory sentences work?
Ah Nolan
Judge Martin Nolan needs to be dragged out of his home. We are leaving our faiths as citizens up to a pedophile apologest at best, an actual pedophile at worst. Why are we okay with this as a society? These people need to be held accountable and pay for this shit.
Are we all seriously this fucking docile as a people?
From the article “Imprisoning people who are no danger to society is a huge waste of money and human life.”
I have to agree. Often the focus is on the “huge waste of money”, but this is a person who made a mistake. He’ll now lose 6 years of the best years of his life because of it. When he gets out he will be severely affected by it through his career prospects, it’ll affect his future relationships, potentially getting married etc.. Something he may have to tell kids if he wants to have any. This will unfortunately be a big defining part of his life.
And his parents, family, friends, will all suffer along with him for 6 years. And all for what? Absolutely fucking no reason at all. He doesn’t need rehabilitation, it’s way in excess of what’s necessary as a deterrent. And what will the tax payer spend on this absolutely pointless exercise? Half a million euro or something like that?
So fucking stupid.
Edit: Just looked the guy up, including a video of him talking about his work as a fitness instructor. Seems like a completely normal, very nice guy. What a pointless waste of a life. For some reason we think it’s unethical to take someone’s life with the death sentence, but have no problem taking away a significant *Portion* of their life by locking them up with no good reason.
Suspended sentences, mitigating factors, and concurrent sentences should not be for career criminals.
Child abuse/images should have tougher sentences.
I think cannabis should be legalised.
6 years is harsh compared to other sentences, but this lad couriered 4m worth of the drug .
Legal system needs a complete overhaul.
Our judiciary are mostly a disgrace and as they are totally unaccountable and beyond any kind of scrutiny, nothing will change. Our new minister for justice is a barrister and very much part of the system, so unlikely to change anything. I predict an early decision of his will be to increase legal aid fees and that he will so it well in advance of an election
It’d be great if literally anyone on this thread read the article.
Unless there are mandatory minimum sentences for possession of child abuse material, your outrage at the judge over this much more severe sentence makes no sense whatsoever.
Key thing here from the article is he didn’t know what drugs he was transporting so that meant it could have been anything from cannabis to crystal meth he was ok to transport. That to me is alot darker and garners little sympathy for them facing consequences for their actions.
But sadly their family are who will suffer the most and had no say in it so sympathies for them.
Should there be a big overhaul of sentencing? Hell yes, it’s madness how you can get suspended sentences for very violent crimes but other crimes that should be fines and community service instead have hard sentencing.
Nolan. Enough said
Irelands injustice system
So pedophiles get a slap on the wrist but trafficking cannabis gets you 6 years in prison. Please make it make sense to me.
How is that justice?
” €4 million worth of cannabis.”
Yeah fuck off with your second chance
As long as *We* continue to say *nothing* and not voice our outrage/anger over somebody who was caught for driving a van full of cannabis who is sentenced for the same length of time as a fucking murderer things will *not* change.
>Inb4 “bUt WeEd iZ DeH DrUgz”
Cannabis is either being legalized or decriminalized all over the world – it’s quickly become a commodity in certain parts, it’s nothing but bureaucratic nonsense in this Banana Republic that I can drink myself to death but heaven forbid I have a joint in the comfort and privacy of my own home.
Don’t really disagree with this sentence but it does highlight the insane bias inherent in our justice system.
Whose views are being reflected in our justice system? Certainly not the publics
Opinions shift on mandatory sentences here. I don’t agree with them, except for murder, but we need judges to not apply the lowest sentencing either.
As for the concurrent sentencing, that’s common in the Irish judicial system and my understanding is that of is that if concurrent sentences don’t happen there’s grounds for appeal as it’s commonplace. So the DPP won’t appeal.
Fucking Martin Nolan again.
Mislabel your garlic, go to prison
Drive a truck with a substance that, let’s face it, from a basic health and safety point of view should be legal so it can be regulated and have some level of quality control (not to mention free up garda resources and take the profits out of the hands of criminals and increase the tax take, but I digress) go to prison.
Rape someone? Suspended sentence
Be found with a terabyte of child sexual exploitation images? Suspended sentence
Rape your child daughter until she’s old enough to leave home? Suspended sentence.
Someone investigate that man, please. These sentences are fucking ridiculous.
Edit: I left out part of a sentence out of pure blind rage at this nonsense.
For the love of good Christ we can’t seem to get anything right these days.
Nolan always seems to find himself struggling with minimum and maximum sentences and technicalities. Would judges not have influence to have someone look into these loopholes and deficiencies in the judiciary?
So hospitalising a homeless man is a suspended sentence even though it’s violent assault. But transporting drugs is a mandatory. Ok I get the second one. That’s not the issue for me. It’s the fact that suspended is an option for violent assault. Surely the standards should be consistent.
He should have told the judge he had child abuse images, would have got off Scott free
Judge Nolan:
Cannabis possession 😡
Absolute vile child abuse 😴
Absolutely ridiculous
I don’t see a problem with him getting 6 years
Am I reading this right? He had 4 million euros worth of Cannibis in his van? That’s drug trafficking amounts. That’s what r/ireland is an outrage over? I assume by the posts here, it was a tiny quantity.
I’m all for legalizing weed, I think it’s stupid it’s not, but until then, he had 4 million euros worth, not 200 euros worth. These gangs terrorize communities and make their money off trafficking drugs like this. The same gangs who employ ‘scrotes’ that this sub loves to hate.
Would the same outrage be here if some of those ‘scrotes’ stealing motorbikes for the same gang got locked up?
Sorry, I do not see the outrage here. Drive around with 4 million euros worth of drugs for a scumbag drug gang and get caught. Tough.
The judge!!!!!!🙈 You couldn’t make this shit up.
On the same day , a 17 year old who done a handbrake turn on the m50 , drove the wrong way endaring other drivers and drive at a Grada car got off because there is no space in prison for him.
I know which person I’d rather see do some time here
