I saw this yesterday and I thought it's quite misleading because:

  1. "Hier gratis zu mitnehmen" make you think there is actually something free to take that is usually paid (a sample, a cookie, a small chocolate, etc) but it's actually just an advertisement flyer, nothing else. Sure it's for free but it's not like other advertisement flyers are paid.

  2. "Dein Glüskslos" while all the QR codes are exactly the same. It's misleading as you might think that one can be more lucky than another but at the end of the day it's just a "give us your data to participate" thing.

What do you think?

  1. Personally I think it’s no more predatory than similar advertisements, these data farming ad campaigns have always been a tradeoff, potential winnings for your data, nothing new

  2. Just ignore them, it’s pretty easy if you try hard enough.

  3. If you see “gratis” in a store, turn off your brain and ignore whatever it is. It is 100% an ad magazine.

  4. Marketing Manager here (Not for Ovo). This is not considered misleading advertisement as it’s clear if you read it what it is about.

    This is your assumption, it doesn’t have to be like this at all and the flyer is in fact for free to take with you.

    And nowhere it says it would be individual / something to scratch or anything else.

    What do I think of it? It’s not the form I would do advertisement, as I agree with you on the point that it could be done better. However, if we look at the UWG (Bundesgesetz gegen unlauteren Wettbewerb) then this doesn’t classifies as misleading advertisement.

  5. if u know German, u see that it clears refer to the Lössli.

  6. Switzerland is interesting with these campaigns that seem to only serve as data collection. For example all the “glückspiel” where you can win an iPhone or whatever. I have received such promotions from mobile network providers that looked so dodgy and amateurish I was sure it’s a scam, but it’s their official marketing to collect and use your data.

  7. Say that something is free, and people turn off their brains.

  10. I am really pissed at stores already abusing the newe law for setting discounts that our corrupt Nationalran and Ständerat changed.

    Migros is advertising that now /500 products are permanently “discounted”.
    For those unaware. Since the beginning of 2025… it is basically possible to lable something as discound without it being an discount, for an unlimited ammount of time.
