Neide da Silva Heiniger, a 49-year-old Brazilian woman, is facing a complex legal battle for custody of her daughter. Moara, 15, currently lives with her father in Switzerland, a country to which she was repatriated in 2022, as determined by law. According to Neide, the young woman is in precarious conditions of private prison, without access to the internet and with little freedom.

How did it all start?
Moara was born in Switzerland, the same country as her father. After the divorce, Neide and her ex-husband began to share custody of their daughter. In 2012, after spending some time with her father, Neide noticed that the girl showed signs of violence and abuse, which led her to seek help at the hospital. "I knew something was wrong and I wanted help," the Brazilian woman explained in an interview with Portal LeoDias.

The doctors, however, did not pay due attention to Moara's injuries – such as serious bruises on her body – and did not even take steps to protect her. "I felt like they were accusing me, that they were blaming me for the situation. But I knew that Moara was not with me at that moment. She was with her father, and he was the one who did this to her," said Neide.

Moving and repatriation
Given the situation of neglect, Neide decided to take her daughter to live in São Luís, in Maranhão, where they lived until 2022. The move was not authorized by her father and, therefore, Moara was forced to return to Switzerland, even against her will. The Hague Convention, an agreement signed by Brazil in 1999, determines that children illegally removed from their countries of origin must be immediately returned to their countries of origin.

Neide, in turn, was accused of kidnapping her daughter and sentenced to 34 months in prison in Switzerland. The decision, handed down in September 2024, will be appealed by the Brazilian, who is seeking financial support to pay for legal aid.

What is the situation like now?

Neide has now moved back to Switzerland, with the aim of staying close to her daughter. Since then, she has been living in an unheated studio in the city of Interlaken, with limited financial support from the Swiss government. Eleven months ago, she had her visits to her daughter suspended, following her father's victory in court.

According to her mother, Moara lives in precarious conditions with her father, with severe restrictions on her freedom. In an isolated village, the young woman is in a kind of private prison, without access to social media. "I just want my daughter to have the right to live her life freely and safely," the Brazilian emphasized.

  2. I live in Brazil, i don’t know if this is true or not, but Leo Dias is not a reliable guy, he is sensationalist and have trouble with drugs. Like i said before this could be true, but i doubt it.

    I believe the mother acted wrong in many different moments and is hiding many facts. The mother alleges a lot of near unbelievable sequence of events.

    I have seen cases where mothers took their kids to Brazil without the father’s permission, when they came back with the kid, nothing happened, not even a slap on the wrist. Even worse, mother was on RAF plus other benefits. Still, no case was opened against her, even with the father trying to press some kind of charges together with a lawyer.
