No, it’s opt in only – having to opt out is against GDPR. Are Lingus? No it’s not allowed. You can no longer have auto opt in and select opt out. So it is legal. But it’s a bit on the dodgy side. Most companies wouldn’t do it but it’s not illegal for Aer Lingus to be doing this.
