Trump Assault On NEPA Will Sow Chaos And Is Doomed To Fail | Getting rid of NEPA will take more than an executive order, it will take an act of Congress. Press releases and tantrums won’t do it.

1. Taking pot shots at the National Environmental Policy Act of 1969 will screw all of us – unless the courts can stop him. Every day a new case is filed. Every week a judge decides to halt Trump’s efforts. Pretty soon he’s going to be tied up in so much red tape that he can’t move. Good. Try to trash our country for what – more money? Screw *you*, Diaper Don.

2. Nonetheless, Trump will shut it down by executive order and hope it gets to the SC where he believes he will win. If not, he will have stopped it for the time taken to get adjudicated by the SC – which can be years in some cases. So in his mind, and immediate win is a win. And that win is backed by a potential final win. It’s the way he thinks. Get the ball rolling in the direction he wants, apply pressure to keep it rolling in that direction, and hope the SC will keep the ball rolling.
